PROJECT SUMMARY: The applicant proposes to construct a single - family residence with associated §404 wetland fill. John Brinkley Page Two 9. PROJECT DESCRIPTION The project site is located at Lot 17 Block 4A Ph -1, SE 63rd Street, Turtle Creek Subdivision, near the Atlantic Ocean, within the Town of Oak Island, in Brunswick County. To find the project site, travel south on US Highway 17 to NC Highway 133 South. Travel approximately 22 miles south on NC -133 to Dosher Cutoff SE/ NC- 133.Turn onto Dosher Cutoff and then turn right at Southport- Supply Rd. SE/ NC -133. Travel approximately 0.8 mile and turn left onto NC -133. Travel on NC -133 to Oak Island and turn right on East Oak Island Drive. Travel approximately 1.6 miles to SE 63rd Street. Make a left on SE 63rd Street and travel 0.1 miles and the lot will be located on right, directly across the street from 114 SE 63rd Street. The vacant lot has a total area of approximately 14,804 square feet, of which approxamitely 1933.3 sq. ft. are considered uplands that are located across the front of the lot along the road. According to the application, the property has an approximate elevation of 8 feet above normal high water. The site is heavily vegetated with Lololly Pine (Pinus taeda), American Holly (Ilex opaca), Red Bay (Persea borbonia), Red Maple (Acer rubrum), Yaupon (Ilex vomitoria), Wax Myrtle (Myrica cerifera) and various other §404 Wetland species. There are no Coastal Wetlands located on the site. The application states the wetland line was delineated by Land Management Group and verified by Kyle Dahl (USACOE) on January 28, 2015. However, verification of the wetland boundaries was not submitted with the application package. The frontal dune and the static line are located over 800' oceanward of the southern property lines. The long term erosion rate for this portion of Oak Island is 2 feet per year. The 100 -year storm recession line for this area is 300 feet, creating a total Ocean Erodible AEC of 420 feet. The Ocean Erodible Area of Environmental Concern (AEC) boundary falls oceanward of the lot. The lot falls entirely within the High Hazard Flood AEC as indicated by zones VI-30 on the Flood Insurance Rate Maps of the Federal Insurance Administration. Setbacks in this portion of Oak Island are measured from a static or fixed vegetation line, unless the actual first line of stable, natural vegetation is more restrictive. This static vegetation line represents the first line of stable, natural vegetation that existed prior to the large -scale spoil deposition project. The vegetation line used for Oak Island is based on the 1998 vegetation line, as described in NCAC 07H .0305(a)(6). With a 2 feet per year erosion rate, structures with a total floor area less than 5,000 square feet must be set back a distance of 60 feet landward from the static line. The 60 foot setback is located approximately 800 feet oceanward of the southern property lines of the lot. The actual first line of stable, natural vegetation is located oceanward of the surveyed static vegetation line. There are no man-made structures currently on the property other than municipal sewer hook -up. The waters of the Atlantic Ocean in the vicinity of the project area are classified SB by the North Carolina Division of Water Resources. The area is not designated as a Primary Nursery area by the North Carolina Division of Marine Fisheries. PROPOSED PROJECT: The applicant is proposing to construct a 1 -story pile- supported single - family residence with associated §404 wetland fill and concrete driveway. As proposed, the total heated floor area of the house would be approximately 2,600 square feet. With the covered porches and driveways, a total built -upon area of 3,649 square feet is proposed. The application states State Stormwater Management Permit No. SW8 920418 was issued for this phase of the Turtle Creek Subdivision which allows a maximum of 5,128 square feet of built upon area for this lot. John Brinkley Page Three Approximately 5,859 square feet of area would be graded and filled for construction, to include approximately 3,914 square feet of §404 wetlands on the lot. The application states that due to the location and amount of §404 wetlands on the lot, avoidance of wetland impacts is not possible. The applicant has submitted a Statement of Credit Availibility letter from the Lower Cape Fear Umbrella Mitigation Bank dated April 29, 2015, for 0.2 non - riparian wetland credits for mitigation. 10. ANTICIPATED IMPACTS: The project would result in the permanent filling of 3,914 square feet of §404 wetlands and approximately 1,945 square feet of high ground disturbance and fill. The residence would result in 3,649 square feet of built -upon area on the lot. The site is located within an Ocean Hazard Area, specifically, a High Hazard Flood Area. Wetland impacts are necessary for lot development. Existing Conditions The lot is located off of SE 63rd Street and is 0.34 -ac in size. The lot is approximately one thousand feet north of the Atlantic Ocean and is within a FEMA- designated VE flood zone (VE -17). The project area is located within the Cape Fear River Basin (HUC 03030005). Freshwater wetlands were delineated by Land Management Group and approved by Mr. Kyle Dahl of the US Army Corps of Engineers on January 28, 2015. No coastal wetlands exist on site. Freshwater wetlands contain red maple (Acer rubrum), American holly (Ilex opaca), red bay (Persea borbonia) and yaupon (Ilex vomitoria). Uplands are limited to an approximately 20' width along the road front and support loblolly pine (Pinus taeda), American holly (Ilex opaca), red bay (Persea borbonia) and yaupon (Ilex vomitoria). The existing land use map in the CAMA Land Use Plan for the Town of Oak Island (2009) classifies this lot as Vacant Land since it is currently undeveloped. The future land use map classifies the project area as Medium Density Residential. The lot is also zoned R -6MF by the Town of Oak Island. The R -6MF district is established to provide areas for the preservation and development of quiet residential neighborhoods and for higher density residential development with a range of housing types. Principal uses in this R -6MF district include larger sized single - family residences, multifamily residences, and other compatible uses. Proposed Project The applicant proposes to construct a one -story, single - family home with a heated floor area of 2,600 square feet. The home will be constructed on pilings to meet FEMA flood zone requirements and will utilize a minimum piling size of 8" in diameter installed to a minimum depth of 8' per NC CAMA Ocean Hazard Area standards. Total area of disturbance within the lot will be approximately 5,859 square feet, and the overall impervious area will be 3,649 square feet. Water service will be provided by Brunswick County and sewer service will be provided by the Town of Oak Island. A stormwater plan will be prepared to meet the Town of Oak Island's stormwater requirements, as needed. Standard construction methods will be used during construction of the pilings and house. Environmental Impacts The applicant proposes to fill a total of 0.089 acre of freshwater wetlands in order to provide sufficient area on which to build a residence. Because of the location and amount of wetlands within the lot, avoiding or reducing the amount of impacts was not possible. Uplands on the property are limited to a 20 foot to 35 foot width along the road frontage. The majority of this upland is located within the 25 foot front building setback required by the Town, so that wetland impacts were not avoidable. Building heights in VE flood zones in the R6MF zoning district are limited to 41 feet. In combination with the first floor elevations required by FEMA, multiple stories are limited. Therefore, a 40 foot by 65 foot building footprint was the minimum house footprint practicable. Parking will be underneath the structure and will minimize wetland impacts compared to a site plan with additional parking sited in front of the house. Fill side slopes also have been minimized to 5 feet in width. The applicant proposes to mitigate for these impacts by buying into the Lower Cape Fear Umbrella Mitigation Bank. Mitigation will be provided at a 2:1 restoration to impact ratio.
