Box 1325 Asheville, N.C. 28802 (828)-251-1900 (828)-251-1945 March 30, 2023 Mr. Dan Boss North Carolina Department of Environmental Health and Natural Resources Water Quality Section 2090 U.S. Highway 70 Swannanoa, NC 28778 Re: Notice of Violation NOV-2023-LM-0019 NPDES Permit NC0033227 TE Connectivity Buncombe County Dear Dan, This letter is written on behalf of the TE Connectivity to provide information as to remedial action taken to the above referenced facility in reference to NOV-2023-LM- 0019 attached. As stated in our monthly report, RPB Systems started operations for TE Connectivity on 6-20-23 and understood James & James resigned on 6-17-23. We sampled TSS on 6-22- 23 with a result of 30.8 mg/L which appeared to match the condition of the wastewater plant in our first week of operation. We later found out James & James collected a TSS the day before our first sample with a result of 306 mg/L. We do not accept this test result from James & James as an accurate result based on observations and test results the day after from our third party lab, Pace Analytical. Even the NH3N results of 42.8 mg/L verses our 28.9 mg/L taken a day apart are abnormal. When this was discovered we reached out to you to see if the results of James & James could be excluded since we did not sample these and were unaware of the sampling event days after they ended their services. We were told we had to report their data as well as ours, which we complied with. As a result we were in violation for daily and monthly TSS. The monitoring violations for dissolved oxygen and pH, missing from the first week of June were before we began inspecting the system. The data up to the start of our operation on 6-20-23 were from the field sheet from James & James sent to the owner. The sheet is attached for your review. We had assumed the data would be included in the DO and pH on the last Tuesday of May, since this is their normal sampling and field test date.
