C<ha rMe c k. arg Facility Name: Anaergia Services, LLC Inspection # : 75339 Contact: Miguel Lugo, Facility Manager Permit #: NCG060387 Inspector: Michael Schley Receiving Stream: Derita Branch Inspection Date: 04/17/2023 Entry Time: 2:00 pm Exit Time: 3:30 pm SIC #: SUMMARY JL Facility Description: Anaergia Services, LLC (Formerly Orbit Energy) facility is located at 600 Johnson Road on approximately 13 acres in Charlotte. The facility receives off -spec food products and other similar materials for use in an anaerobic digestion process that produces methane, which is subsequently captured and used for energy production. File Review/History: Charlotte -Mecklenburg Storm Water Services (CMSWS) has previously conducted Industrial Inspections at the facility on September 3, 2020 and May 22, 2018. CMSWS issued Notices of Violations (NOVs) to the facility as a result of additional investigations on August 31, 2021, May 2, 2018, January 30, 2018, and November 1, 2017, with each of the NOVs issued due to discharges of wastewater. Additional follow-up inspections were conducted on various other dates for the issued NOVs. In addition, civil penalties were assessed on June 21, 2018 and October 14, 2021. Inspection Summary: Charlotte Mecklenburg Storm Water Services (CMSWS) previously inspected the facility on March 21 & 23, 2023 and an NOV was issued for Improper Storage and Handling as a result of those inspections. This inspection was conducted as a follow up inspection for the NOV. At the time of the inspection, the facility was observed to have improved site conditions in terms of material storage and handling and overall housekeeping. The facility should continue completion of corrective actions as described in recently issued NOVs and follow related guidance of CMSWS. f Site Inspection Deficiency Comments Stormwater system (catch basins, Recommendation Remediation of the facility's stormwater system is ongoing inlets, outfalls, etc.) from the illicit discharges which recently occurred at the facility and resulted in multiple NOV's. The facility should continue remediating all affected areas of the stormwater system. Erosion issues Recommendation Interior roads throughout the facility were observed to be improved since previous inspections but there was still considerable sediment buildup and tracking. Per facility staff, interior roads throughout the facility will be repaved to help with tracking and erosion issues. CMSWS recommends the facility continue to practice sweeping and good housekeeping procedures to help protect water quality. Structural stormwater control Recommendation Remediation of the SCM pond is ongoing. Per facility staff, measures (SCMs) original plans for the SCM are trying to be located and future plans are being developed. The facility should continue remediation of all affected areas and work with CMSWS staff to develop future plans for the SCM pond and additional secondary containment onsite. Illicit discharges/connections Recommendation No illicit discharges were observed onsite during the inspection. Liquid in the AST secondary containment dispenser(s) — list tank size(s) and area was being prepared for disposal. No stormwater pollution contents issues were observed. Underground storage tank(s) (USTs) N/A and any associated fill port area(s) and dispenser(s) — list tank size(s) and contents Outdoor material storage area(s) Recommendation Food waste awaiting production is now dropped off at the loading dock and stored inside the facility. Minor amounts of food waste was observed outside on the ground at the dumpster and loading area. CMSWS recommends the facility continue to practice good housekeeping procedures to help protect water quality. Outdoor processing area(s) No Pumps for the floor drains in the tank farm areas, which are pumped back into the facility's wastewater reclamation system, were observed to be operable at the time of inspection. No stormwater pollution issues were observed. Loading/unloading area(s) Recommendation A solid waste compost byproduct was observed to be stored in a partially covered area where it can intermix with stormwater and be tracked throughout the facility. Per facility staff, the facility is developing solutions of how to adequately contain the solid waste compost byproduct. CMSWS recommends collecting the material in containers kept under cover to avoid the material being intermixed with stormwater or being tracked through the facility during loading and unloading operations. Vehicle/equipment area(s) - fueling, N/A maintenance, washing, storage, etc. Oil/water separator and/or N/A pretreatment Waste storage/disposal area(s) - No Open top waste containers were removed from the drainage open tops, waste containers, scrap channel along the entrance road. The drainage channel was metal bins, etc. remediated of contaminated soils due to leachate from the waste containers, and stone was added along the drainage channel to protect against erosion. Open top dumpsters are now stored near the loading area. Floor drains in the loading area are pumped back to the facility's wastewater reclamation system. Reference the 'Outdoor Storage' section for recommendations. Food service area(s) N/A Indoor material storage area(s) No Food waste was observed to be stored indoors.
