Report suspicious emails with the Report Message button located on your Outlook menu bar on the Home tab. ----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------- Subject: Follow-up Industrial Facility Inspection Charlotte Bioenergy Facility, LLC Dear Miguel Lugo: On April 17, 2023, Michael Schley, Richard Farmer, John Thao and Craig Miller of Charlotte - Mecklenburg Storm Water Services (CMSWS) conducted a follow-up inspection of the above referenced facility under authority granted by Charlotte City Code Chapter 18, Article III, Section 18-82. At the time of inspection, the facility was observed to have improved site conditions in terms of material storage and handling and overall housekeeping. The facility should continue completion of corrective actions as described in all recently issued NOVs and follow related guidance of CMSWS. The following observations were made during the re -inspection: 1. Charlotte Storm Water Pollution Control Ordinance Review • Stormwater System — Remediation of the facility's stormwater system is ongoing from the illicit discharges which recently occurred at the facility and resulted in multiple Illicit Discharge NOV's. The facility should continue remediating all affected areas of the storm water system. • Erosion Issues/Outdoor Material Storage — Interior roads throughout the facility were observed to be improved since previous inspections but there was still considerable sediment buildup and tracking. CMSWS recommends the facility continue to practice sweeping and good housekeeping procedures to help protect water quality. • Loading Area- A solid waste compost byproduct was observed to be stored in a partially covered area where it can intermix with stormwater and be tracked throughout the facility. CMSWS recommends collecting the material in containers kept under cover to avoid the material being intermixed with stormwater or being tracked through the facility during loading and unloading operations. The initial inspection was also conducted as part of a cooperative working agreement between Mecklenburg County and the North Carolina Department of Environmental Quality (NCDEQ) — Division of Energy, Mineral and Land Resources (DEMLR). NCDEQ — DEMLR has been copied on the reports and made aware of the following observations regarding the facility's NPDES stormwater permit: 2) Stormwater Pollution Prevention Plan (SWPPP) A Stormwater Pollution Prevention Plan (SWPPP) has been developed, recorded, and implemented. However, several deficiencies were observed. 3) Qualitative Monitoring Qualitative monitoring has not been conducted and recorded as required. 4) Analytical Monitoring Analytical monitoring has not been conducted and recorded as required.
