Dear Mr. Lappin:
The City of Monroe Engineering Department has reviewed the subject erosion and sedimentation control plan.The
noted plan has been reviewed and is found to be acceptable under conditions; therefore, you are issued this
Conditional Letter of Approval and Certificate of Plan Approval.Plan approvals shall expire within three(3)years
following the date of this approval if no land disturbing activity has been undertaken, as required by the City of
Monroe Code of Ordinance Chapter 158.16 (G). The Certificate of Approval, NCGO1 permit, Certificate of
Coverage (COC) and record of inspections must be posted at a conspicuous location at the job site. If you proceed
prior to approval of all plans you are doing so at your own risk. Please contact the Permit Center to ensure you have
all approvals needed to begin.
Chapter 158.16 (H) of the City Ordinance requires that a copy of the conditional approved erosion control plan be
on file at the job site.In addition,the City maintains the right of entry for periodic inspection as indicated in Chapter
158.17 (D) of the City Ordinance and by the G.S. 113A-61.1(a). This letter is due notice of such inspection.
As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice of
Intent (NOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction Stormwater
General Permit. This form MUST be submitted prior to the commencement of any land disturbing activity on the
above named project. After the NOI is reviewed and found to be complete, you will receive a link with payment
instructions for the $100 annual permit fee. Once the fee is received, the COC will be emailed to you. If the
owner/operator of this project changes in the future,the new legally responsible entity is required to apply for their
own COC. The $100 fee is charged annually until a Notice of Termination(NOT)is submitted and approved. You
MUST obtain the COC prior to the commencement of any land disturbing activity. The NOI form may be accessed
at deq.nc.gov/NCG01. Please direct questions about the NOI form to Alaina Morman at

Title 15A NCAC 4B .0118(a) and the NCGO1 permit require that the following documentation be kept on file at
the job site:

1. The approved E&SC plan as well as any approved deviation.
2. The NCGO1 permit and the COC, once it is received.
3. Records of inspections made during the previous 30 days.
North Carolina's Sedimentation Pollution Control Act is performance-oriented, requiring protection of existing
natural resources and adjoining properties. If, following the commencement of this project,the conditional erosion
and sedimentation control plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act
of 1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions to the plan and
implementation of the revisions to insure compliance with the Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water quality
laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land
disturbing activity. This approval does not supersede any other permit or approval.
The erosion control permit can be issued prior to an approved Stormwater Management Permit once all erosion
control requirements are met. However, any changes to the plan during the Stormwater Management Permit
approval process that significantly alters the erosion control plan shall be addressed through a revision submittal.
The developer proceeds at their own risk prior to receiving all approvals associated with site development.
Please note that this conditional approval is based in part on the accuracy of the information provided in the
Financial Responsibility Form, which you provided. You are requested to file an amended form if there is any
change in the information included on the form. Please notify us to set up a preconstruction meeting prior to
disturbing any land. If a preconstruction is not set up it will be a violation.

PROJECT CONDITIONS
Project Name: DJJ Monroe Scrap Processing

Disturbed Area: 11 Acres
Location: 179 S.Bivens Rd
1. The current NCDOT driveway permit is temporary. It only allows one access point onto Bivens Rd., 350
feet from the intersection of Andrew Jackson(US-74) and Bivens Rd. (SR 1763)towards Monroe
Ansonville Rd(SR 1751). This access is to serve the proposed DJJ Monroe Scrap Processing Facility.
This access is temporary and approved for the NCDOT for only 1 year from February 17,2023.A
permanent driveway permit from the NCDOT will need to be issued before a Certificate of Occupancy is
issued by the City of Monroe.
