Dutch Farms Bank Parcel Credit Release — Task I
Dear Mr. Mascia:
On April 25, 2022, the Division of Water Resources (DWR) approved a Buffer Mitigation and
Nutrient Offset Plan (Plan) for the above -referenced site under the terms and conditions of the Davey
Resource Group, Inc. (Davey) DM Dutch Farms Mitigation Banking Instrument (MBI) to establish a
nutrient offset and riparian buffer mitigation bank. On November 28, 2022, the US Army Corps of
Engineers issued a Notice of Intent to Approve the Dutch Farms Stream Mitigation Plan.
DWR received a performance bond (#K41613610) issued to Davey from Federal Insurance
Company, in the amount of $150,000, to cover performance obligations for the construction of the
subject site. The terms of this bond will terminate upon approval of the As -Built and Baseline
Monitoring Report by the DWR.
On April 26, 2023, the DWR received recorded conservation easements and corresponding plats for
the subject site. Wildlands provided confirmation that the conservation easements for the subject site
have been successfully assigned to Broad Water Innovations (BWI). BWI is a 501(c)(3) non-profit
corporation and has been approved by DWR as a long-term steward for this mitigation bank.
In accordance with the MBI, signed on January 26, 2023, the following Project Milestones have been
met and the corresponding credits shall be released:

The delivery factors applied to this bank due to its location in the 14-digit HUC 03 03 00020400 10 are
30% for nitrogen and 14% for phosphorous. Therefore, the total amounts of delivered nutrient offset
credits for this site are 129.431 lb-N and 3.862 lb-P.

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract and the following credits are being released and are now available to sell:
• 25% of the Jordan Lake riparian buffer Restoration credits
(0.25 x 501,949 ft2 = 125,487.25 ft2)
• 25% of the Jordan Lake riparian buffer Enhancement and Preservation credits
(0.25 x 17,314.500 ft2 = 4,328.625 ft2)
• 25% of the delivered nitrogen offset credits (0.25 x 129.431 lb-N = 32.358 lb-N)
• 25% of the delivered phosphorus offset credits (0.25 x 3.862 = 0.965 lb-P)
Please note that the delivered nutrient offset credits must be used for impacts in the Haw River
Arm of Jordan Lake within the Cape Fear River Basin according to 15A NCAC 02B .0703.
Additionally, riparian buffer credits can only be used to offset impacts located in the Haw
River Sub Watershed of Jordan Lake according to 15A NCAC 02B .0295, which became
effective on November 1, 2015.
Please use the Jordan Lake Credit Ledger Templates provided in the approved MBI to track and
report credit availability for the Dutch Farm Mitigation Bank. Upon receiving this correspondence,
please submit our credit ledgers to DVWR reflecting the available credits released for each mitigation
type as follows: Buffer Restoration, Buffer Enhancement w/ Preservation, Nitrogen Nutrient Offset,
Phosphorus Nutrient Offset.
