to exceed ten thousand dollars ($10,000). 1 hereby request exclusion from NPDES stormwater permitting.

An inspection was made of the above mine on January 24, 2023, in accordance with G.S. §74-56 of the Mining Act
of 1971.
The mine was found to be satisfactorily reclaimed per the mine reclamation plan and is now operating under the
Division of Waste Management (DWM) Closure Permit 1910-STRUC-2015. Therefore, your company is released
from further reclamation responsibility for this site with respect to the Mining Act of 1971. The mine reclamation
blank bond on rile will remain in force to cover your company's other permitted sites.

Release by re -purposing
Mine Permit Number 19-25, Brickhaven No. 2 Mine, Tract "A"
Orange County
Request. The Company is requesting that the site be repurposed to a Structural File, and released from
the site's mining permit.
Time Line:
June 9, 2022 Green Meadow, LLC's consultant request the site be released from the site's mining
permit. All aspects of the mining portion of the have been met.
September 18, 2022 Bill Denton, Lauren Garcia, both from the RRO inspect the site, and found that
some areas need additional revegetation work, and the site map need updating.
October 7, 2022 Adam Parr, Assistant State Mining Engineer, send notice to the company that
the site could not be released at that time.
January 24, 2023 The site is re -inspected by Bill Denton, Lauren Garcia of the RRO staff, and found
the met reclamation condition.
February 1, 2023 Site is released from the Mining Permit, but is still DWM Closure Permit 1910-
STRUC_2015.
Discussion:
As documented in this memorandum, the Mining Program recommends release of 301.0 permitted
acres. The company is using a blanket bond for all of it's site, so the Division will retain the security.
This site will still be under an erosions control per DWM Closure Permit 1910-STRUC_2015.

Dear Joyce,
On behalf of Green Meadow, LLC, please see attached for a completed NPDES Rescission Request Form for the former
Brickhaven Mine Site Tract "A" which was granted coverage under NPDES permit No. NCG020354.
As of February 1, 2023, we have closed out the mine permit (No. 19-25) for the former Brickhaven Mine Facility with NC
DEMLR and no longer need coverage under the mining General Permit for both stormwater and wastewater. All BMPs
have been converted or removed after site stabilization was achieved (required for release from the mining permit).
The Brickhaven facility has entered post -closure care with the NC DEQ Division of Waste Management and has erosion
and sediment control inspection requirements that we are adhering to.
I have also attached a copy of the release letter from NC DEMLR for the mine permit dated February 1, 2023.
As directed, I will also place a hard copy of the attached documents in the mail to your attention.
