This office has received your plan for Waynesville Commons in Haywood County, North
Carolina,. Your plan was submitted to this office for approval because of the proposed encroachments on
a designated trout waters buffer zone.. In accordance with NCGS 113A-57(1) and Title 15A NCAC 4B
.0125(c) this letter will serve as writtea approval to encroach on the buffer zone of the Little River Class
C, Trout. This authority tras been delegated to me by tiro Director, Division of Land resources, lames D.
Simons, in accordance with NCGS 143B-10. The following conditions will apply to this approval:
1. This approval is based on fhe plans received April 4, 2007.
2. No land disturbing shall take place outside the existing fence alobg Richland Creek and Allen
Creek except as noted as the above plan.
3. All construction and erosion and sedimentation control materials shall be on site before any work
in the trout buffer begins and stockpiled outside of the buffer.
4. Any excavated materials stockpiles shall be located outside of the trout buffer and have adequate
sediment and erosion cantxol measwes.
5. No land disturbing activity shall take place within the trout buffer zone from October 15 to April
15 of each year,
6. All disturbed areas within the trout buffer shall be stabilized with an adequate ground cover at the
end of each workday.
7. The Division of Land Resources local office in Asheville shall be notiified prior to beginning the
encroachment into the Trout Buffer Zane. 1f 1 d disturbance in the trout buffer continues for
more than one day, the Asheville Office must be notified each day. The contact person is Gene

North Carolina's Sedimentation Pollution Control Program is performance-oriented,
requiring protection of existing natural resources and adjoining properties. If, following the
commencement of this project, it is determined that the erosion and sedimentation control
plan is inadequate to meet the requirements of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statute 113A-51 through 66), this office may require revisions
to the plan and implementation of the revisions to insure compliance with the Act.
Acceptance and approval of this plan is conditioned upon your compliance with
Federal and State water quality laws, regulations, and rules. In addition, local city or county
ordinances or rules may also apply to this land-disturbing activity. This approval does not
supersede any other permit or approval.
Please be aware that your project will be covered by the enclosed NPDES General
Stormwater Permit NCG010000 (Construction Activities). You should first become familiar
with all of the requirements for compliance with the enclosed general permit.
Please note that this approval is based in part on the accuracy of the information
provided in the Financial Responsibility Form, which you have provided. You are requested
to file an amended form if there is any change in the information included on the form. In
addition, it would be helpful if you notify this office of the proposed starting date for this
