The original is being mailed to me. This completes all of the information that I need to give approval of the stormwater plan for the site. I've attached the modified language for an approval letter that now includes the final signature dates. Please let me know if you need anything else. The Division approves the stormwater management plan (SMP) consisting of the calculations, Supplements, and drawings received on April 9, 2015. These items are now incorporated by reference and are enforceable by the Division. The following conditions also apply: a) The maximum allowable impervious area for the approved project shall 12.10 acres as provided in the Low Density Supplement. b) The footprint of all stormwater management devices as well as an additional 10 -foot wide area on all sides of the devices shall be located in public rights -of -way, dedicated common areas or recorded easement areas. The final plats for the project showing all such rights -of- way, common areas and easement areas shall be in accordance with the approved plans. c) The approved SMP shall be constructed and operational before any permanent building or other structure is occupied at the site. d) The SMP may not be modified without prior written authorization from the Division prior to the commencement of the modifications. e) Maintenance activities for the three dry detention basins and the Swale system shall be performed in accordance with the notarized maintenance agreements signed by the owner, Charlie Aultman, on April 9 and May 7, 2015. These agreements shall transfer with the sale of the land or transfer of ownership /responsibility for the BMP facilities. The Division shall be notified promptly of every transfer. f) The applicant and /or authorized agent shall provide a completed Certificate of Completion form to the Division within thirty (30) days of project completion (available at httl2:/ /12ortal.ncdenr.org/ web /wq/swl2/ws /401 /certsandl2ermits / apply /forms Thank you for your attention to this matter.
