This letter is in response to a Notice of Violation with the intent to enforce that has been issued against
the City of Eden Collection System Permit No. WQCS00018.
We understand that an NOV with the intent to enforce is being issued for incident numbers 202001748
and 20201783. These overflows to surface waters occurred on June 1 and June 2, 2020 respectively. The
cause of the overflows were two separate equipment failures of the rental equipment. The pump head
failed in the June V, then the hydraulic pump drive failed on June 2nd.
On May 25, 2020 severe flooding of the Smith River brought a log jam downstream with enough
elevation and force that it ran into the sanitary sewer gravity line that rests at the base of the railroad
trestle, located southwest of 601 N Van Buren Rd., separating the pipe and dragging a large section into
the River. This left the sewage flowing directly into the river until bypass pumping could be established.
The City already owned a pump and hydraulic power unit with the capabilities to perform the job. KRIS
was contracted to run the polyethylene line across the trestle with the proper connectors. However,
once this was set up it was determined the City needed to have a backup pump on standby in case of
failure, so the City rented a pump and hydraulic power unit from Sunbelt Rentals of the same brand and
models as were already being used for the bypass pumping operation. This setup arrived on July 1,
2020.
Incident number 202001748, occurred on June 1, 2020, later the same day the pump and hydraulic unit
were delivered, when the head of the rented pump failed and was no longer pumping. It was at this
time, it was discovered that the connections for the City owned pump was different from the one
owned by Sunbelt city in spite of it being the same brand and model. Sunbelt was immediately
contacted around 5:30 PM and they delivered a replacement pump from Raleigh as soon as they could
around 10:45 that evening. Sunbelt said they would supply the City with the adapters for the
connections as soon as they could so this would not happen again.
Incident number 202001783, occurred when the hydraulic unit for the rented pump failed due to a
loose relay wire. On June 2, 2020 at 11:27 the rented hydraulic power unit went for no apparent reason
went down. Once again Sunbelt was contacted and they hurried with a second hydraulic power unit and
the adapters they promised arriving at around 3:00 PM. The tech from Sunbelt checked the original
rented hydraulic unit, found a loose relay, repaired it and it was put back in service. He also gave the
City of Eden the adapters to switch equipment over as needed.
Enclosed is a copy of the delivery ticket for the pump head replacement.
Please take these facts into consideration when deciding what action to take.

A review has been conducted of the self -reported Sanitary Sewer Overflows (SSO's) 5-Day Reports submitted by
City of Eden. The Division's Winston-Salem Regional Office concludes that the City of Eden violated Permit
Condition I (2) of Permit No. WQCS00018 by failing to effectively manage, maintain, and operate their collection
system so that there is no SSO (Sanitary Sewer Overflow) to the land or surface waters and the SSO constituted
making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required by
G.S. 143-215.1.
The Winston-Salem Regional Office is providing the City of Eden an opportunity to provide evidence and
justification as to why the City of Eden should not be assessed a civil penalty for the violation(s) that are
summarized below:

This Notice of Violation / Notice of Intent to Enforce (NOV/NOI) is being issued for the noted violation. Pursuant
to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed
against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any
permit issued pursuant to G.S. 143-215.1.
This office requests that you respond to this Notice, in writing, within 10 business days of its
receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other
actions taken to prevent the recurrence of similar situations. The response to this correspondence will be
considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface
waters, duration and gravity, impacts to public health, fish kills or recreational area closures. Other factors
considered in determining the amount of the civil penalty are the violator's history of non-compliance, the cost of
rectifying the damage, whether the spill was intentional and whether money was saved by non-compliance.
