Notice of Violation and httent to Assess Civil Penalty
Dear Mr. Snider:
Aqua North Carolina, Inc. (Aqua) offers the following response to the above -referenced Notice of Violation
and Intent to Assess Civil Penalty which -was issued for BOD and TSS daily maximum exceedance on
October 21, 2020.
Agua's Response: Aqua's ORC indicated that he witnessed a white liquid substance coming into
the plant influent late the second week of the month. It was never identified, but it is believed to have been
a discharge into the collections system. The ORC collected samples and sent them to a state certified lab
for MLSS and MLVSS. However, the lab did not nm the samples. The ORC confirmed with the lab that
they overlooked these special samples. The substance cleared on its own the following week. Due to the
low flows and size of this wastewater treatment plant, small illicit discharges can impact the treatment
biomass and effluent quality.
Aqua's Director of Operations, Area Manager and Regional Supervisor visited the site with the
ORC and have developed and implemented an "Upset Response Plan". If a similar situation is observed in
the future, Aqua will block influent from entering the treatment process and have it pumped and hauled.
Samples pulled for any investigation in the future will be split with half being held in reserve to prevent a
recurrence of the error with the lab. Additionally, a rigorous review of the collection system will occur at
the same time.
