Bypass caused by operator error. Operator left plant in waste mode
when he left for the day on Friday, 10/1112019. so the pumps filled
the digester and then it overflowed into the creek. A different operator
found the bypass at 2PM on Monday, 10114/2019.

On October 15, 2019, at 9:12AM, Ron Boone of the NC Division of Water Resources (NCDWR)
Winston-Salem Regional Office (WSRO) was notified by Chris Bitterman of Envirolink, Inc, of a bypass that
occurred at the wastewater treatment plant (WWTP) for Stone Highway Mobile Home Park. According to Mr.
Bitterman, the bypass began late on Friday, October 11, 2019, or early on Saturday, October 12, 2019, after
the operator mistakenly left the plant in waste mode when he departed on 10/1112019 after conducting his
daily operations. It wasn't discovered that the plant was left in waste mode unfit Monday, October 14, 2019,
at approximately 2PM, by another Envirolink operator. Therefore, the pump(s) was/were left in waste mode
over the entire weekend, at some point overflowing the digester. The overflowing solids and wastewater
made its way to the WWTP's receiving stream, which is an unnamed tributary to Buffalo Creek (Class WS-
IV waters) located in the Roanoke River Basin. At the time of his notification to NCDWR, Mr. Bitterman
estimated the total amount of solids/wastewater spilled to the stream as a result of this event was 25,000
gallons. On Wednesday October 16, 2019, Mr. Boone visited the WWTP and the receiving stream to confirm
the impacts of the bypass.
Please note that this incident represents an unauthorized bypass, which is prohibited under Part II,
Section C, Paragraph 4, of the facility's NPDES permit number NC0060623. Therefore, this Notice of
Violation and Intent to Issue a Civil Penalty is being issued to you, the Pennittee, for the noted violation.
Violations of the NPDES permit subject you to potential civil penalty assessments not to exceed $25,000 per
day, per violation, pursuant to Part Il, Section B, Paragraph 1(f) of the NPDES permit.
This office requests that you respond to this Notice, in writing, within 10 business days of its receipt.
In your response, you should address the causes of non-compliance, remedial actions, and all other actions

taken to prevent the recurrence of similar situations. The response to this correspondence will be considered
in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface waters,
duration and gravity, impacts to public health, fish kills or recreational area closures. Other factors considered
in determining the amount of the civil penalty are the violator's history of non-compliance, the cost of rectifying
the damage, whether the spill was intentional and whether money was saved by non-compliance.

Standard Operating Procedure for Wasting at Stone,
Highway MHP Wastewater Treatment Facility
Wasting of solids from the aeration basin to the digester is necessary on a frequent basis. Due to
the setup at this facility, it is possible to overflow the digester if flow is diverted to the digester
for long periods of time. A channel carries pumped wastewater from the bottom of the aeration
basin to the top. This channel has a plate that can be removed and placed in a manner so as to
divert this flow from the aeration basin to the digester for wasting. If this plate is removed and
not placed back into the channel to completely divert flow, the flow is split roughly in half, so
that flow goes both to the aeration basin and to the digester. Used in this manner, there is not
enough flow volume to overflow the digester. The limited flow, even if left alone for days,.
would be small enough to be drained through the overflow pipe at the top of the digester. Thus,
the following steps shall be followed each time an operator is wasting:
1) When the operator determines that wasting is necessary, he/she must remove the plate
from the "RETURN" position. This plate will be placed upright along the fence on the
western side of the plant.
2) The operator shall determine when enough sludge has been diverted into the digester. At
this time, he/she'shall replace the plate in the "RETURN" position.
3) At no time is the plate to be placed in the "WASTING" position, as this leaves the
potential for overflowing the digester.

The operator inadvertently left the return pumps diverted to the digester for wasting on Friday October 11
during his daily site visit. When the digester filled, the overflow pipe could not support the excessive flow and
the solids went to the effluent. It was left in this manner until discovery by the backup operator on Monday
October 14.

Upon discovery at 14:00 on Monday October 14, the backup operator diverted flow from the digester back to
the aeration basin. He then pumped solids from the chlorine contact chamber back into the aeration basin.
The combination of these two actions resulted in an immediate cessation of overflow from the digesterto the
chlorine contact chamber, and thus the flow to the outfall also ceased immediately. Ron Boone of NC DEQ-
DWR was contacted Tuesday, October 15, 2019, at approximately 0900;

WWTP Upset, Spill, or Bypass 5-Day Reporting Form
Because solids from the treatment plant had bypassed the treatment process and were discharged to
surface waters, not all of the spill could be recovered. However, pump trucks were brought on site to pump
the remaining solids from the creek and back into the treatment plant. A 2" submersible pump was placed
approximately 200' downstream of the effluent/outfall. This pump moved, downstream sludge upstream to
the location of the pump trucks so that as much of the spill as possible could be recovered.
An SOP has been drafted describing a new procedure for wasting at this facility (see attached). When
implemented, this SOP will prevent a bypass from occurring in the future by eliminating the chance for
overflowing the digester.
Additional Comments About the Event:
Ron Boone of DWR was on site 10-15-2019 to assess the situation and pull samples.
