Snider and Ron Boone Winston-Salem Regional Office This le Lis in response to the NOV issued on 10-5-20, tracking numbe. or permit number On the morning of 4-22-20 at approximately 0645, operator Jeff Spainhour found the tertiary filter at the Randleman WWTP to be inoperable. Upon further inspection it was found that one of the bolts that holds the hood on to the traveling bridge had broken. This failure then in turn caused other parts to be bent and broken. In making the repairs to the broken parts we discovered that the P strip that seals the hood to the cells had also been damaged. We ordered the appropriate parts and reported the damage to your office. I spoke with Paul Dimatteo at approximately 1330 on 4-22-20 and followed up with an email to Paul on that same day. On 5-6-20 we completed repairs to the filter and restored it to service. At the time of the breakage I did not anticipate there being any issues with compliance but unfortunately that same week we received a substantial amount of rain, which conversely resulted in elevated BOD levels above our weekly limits. This unfortunately also resulted in us being out of compliance for the month. I regret this happened and we made repairs as quickly as we could. We reacted as quickly as we could and made every effort to maintain compliance. We spent $2231.50 on parts and repairs. We feel that a civil penalty will only hinder our efforts to continue to make upgrades to our system, especially in this current climate with COVID-19 affecting incoming revenue to the City. Further financial burden on us will only make it harder for us to responsibly operate our system to maintain compliance. Because of our efforts and due to the financial burden, I respectfully ask that you consider not issuing a civil penalty for these reasons. A review of your response will be considered along with any information provided on the submitted Monitoring Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no response is received in this Office within the 10-day period, a civil penalty assessment may be prepared. Remedial actions should have already been taken to correct this problem and prevent further occurrences in the future. The Division of Water Resources may pursue enforcement action for this and any additional violations of State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems, and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by Consent. Reminder: Pursuant to Permit Condition 6 in Section E, the Permittee is required to verbally notify the Regional Office as soon as possible, not to exceed 24 hours, from first knowledge of any non-compliance at the facility including limit violations, bypasses of, or failure of a treatment unit. A written report may be required within 5 days if directed by Division staff.
