9. PROJECT DESCRIPTION
The proposed project is located at 809 Shoreline Dr. W in Sunset Beach, Brunswick County. Existing structures on
the 1.39-acre parcel include a single-family residence and an existing two -slip docking facility. Based on DCM
records, General Permit No. 39038D was issued on 7/30/04 for a two -slip docking facility that included a 6' x 339'
access pier, 14' x 18' gazebo, 4' x 45' finger pier, 6' x 12' floating dock, and two 10' x 10' boathouses. Reissued
General Permit No. 39855D was authorized on 1/20/05. Existing structures include a 6' x 332' access pier, 12' x 19'
gazebo, 5' x 16' open platform, 6' x 9' finger pier, 8' x 16' floating dock, and two 13' x 13' open boatlifts. No
permit history can be found for the existing design but based on historical imagery, it appears the current layout was
built by the previous owner around the time of the 2005 reissued General Permit.
The south facing property is located approximately 10' above normal high water (NHW) and is vegetated with
typical coastal -plain tree species and landscaping ornamentals. The property has approximately 131 linear feet of
shoreline frontage along the southern edge and is stabilized with natural vegetation. The adjacent riparian parcel to
the east is 807 Shoreline Dr. W and has a residential structure and a private docking facility. The adjacent riparian
parcel to the west is 811 Shoreline Dr W and has a residential structure and a private docking facility. To the north of
the applicant's parcel is Shoreline Dr. W. No Section 404-type wetlands appear present within the project area. High
marsh, primarily consisting of Black Needlerush (Juncus roemerianus) and Salt Meadow Cordgrass (Spartina
patens): extends approximately 10' waterward of high ground and transitions to approximately 210' of Smooth
Cordgrass (Spartina alterniora). The width of the waterbody measures approximately 540' from marsh to marsh in
the vicinity of the project area.
The waters of the AIWW are classified SA by the Division of Water Quality and ARE designated as a Primary
Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to replace and extend an existing 2-slip docking facility to the established pier -head line to
access deeper water along the AIWW in Sunset Beach.
The applicant proposes to remove the existing access pier and rebuild a new access pier originating from the same
high -ground location. The proposed 6' x 332' access pier would start on the high ground and extend south across
approximately 10' of high marsh. From the NHW line, the access pier would continue south approximately 212'
over a stand of Smooth Cord Grass (Spartina alterniflora). From the waterward edge of Coastal Wetlands, the access
pier would extend approximately 90' into the AIWW before reaching the existing 6' x 8' finger pier on the east side
of the access pier. The access pier would continue south another 10' and terminate at the existing 17' x 16' fixed
platform with a 12' x 19' roofed portion (See Sheet 2 of 4). As proposed, a 6' x 20' access pier extension would
continue south beyond the existing 17' x 19' fixed platform and terminate with a proposed 12' x 12' fixed platform
with a 6' x 13' roofed portion located at the established pierhead line between 709 Shoreline Dr. W and 811
Shoreline Dr. W. To the west of the proposed fixed platform, a relocated 13' x 13' open boatlift would be installed at
the established pierhead line (Slip #2, See Sheet 3 of 4). To the east of the proposed fixed platform, the relocated 8'
x 16' floating dock would be oriented perpendicular to the shoreline and provide access to a relocated second 13' x
13' open boatlift on the east side of the floating dock (Slip #1, See Sheet 3 of 4). The floating dock and eastern
boatlift (Slip 41) would be accessed from a proposed 6' x 8' finger pier and gangway located on the east side of the
proposed 6' x 20' access pier extension. The applicant states that extending the docking facility to the established
pierhead line would allow him to reach navigable water depths throughout the tidal range and minimize soft -bottom
impacts to the Primary Nursery Area (PNA).

The property has approximately 131 linear feet of shoreline and the proposed design appears to remain within the
applicant's area of riparian access; no waivers would be required for the proposed project and no waivers were
obtained by the applicant. The applicant's design extends waterward of the'/4 width limit but remains landward of
both the 1 /3 width and the USACE Federal Channel Setback (See Sheet 2 of 4). The applicant proposes to extend to
the pierhead line established between 709 Shoreline Dr. W (State Permit #22-18) and 811 Shoreline Dr. W (GP#
66385D). Water depths taken by DCM staff at 2:45pm on 4/5/23 in the location of the existing boatlift and floating
dock ranged from -0.5' NLW (-0.2' NLW adjusted) on the landward edge of the floating dock to -0.7' NLW (-0.4'
NLW adjusted) on the waterward edge of the floating dock. Water depths taken by DCM staff at the proposed
location ranged from approximately -0.9' NLW (-0.6' NLW adjusted) at the landward edge of the proposed floating
dock to -1.6' NLW (-1.3' NLW adjusted) at the waterward edge of the proposed floating dock. The applicant
proposed to install physical stops at 18" above substrate under the relocated floating dock and to also set the boatlift
limit switches to stop at 18" above the substrate. As proposed, the docking facility would extend approximately 151'
from the edge of Coastal Wetlands to approximately 27% of the waterbody width.
10. ANTICIPATED IMPACTS
The proposed docking facility would result in the shading of approximately 1,350 sq. ft. of Coastal Wetlands and the
incorporation of approximately 6,522 sq. ft. of Estuarine Waters and Public Trust Area. As proposed, the docking
facility would be located in an area with water depths ranging from -0.6' NLW to -1.3' NLW (when adjusted) within
a Primary Nursery Area. The applicant has proposed to set limit switches to 18' above substrate on the relocated
boatlifts and install physical stops at 18" above substrate under the relocated floating dock to reduce soft bottom
impacts.
The proposed development would be located outside of both adjacent 15' riparian corridor setbacks. The proposed
docking facility would be constructed at the established pierhead line which is beyond the'/4 waterbody width but
landward of the 1 /3 waterbody width and the USACE Federal Channel Setback. Minor increases in turbidity should
be expected during piling installation.
The square footage of the proposed docking facility is calculated as follows:
Shoreline length = 131ft. x 8 sq. ft. =1,048 sq. ft. allowable.

Dear Mr. Brink:
The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for David
and Carol Martin, for State approval for the construction of a two -slip docking facility, located 809 Shoreline Dr. W,
Sunset Beach, Brunswick County, NC. It was received complete April 19, 2023 and appears to be adequate for
processing at this time. The projected deadline for making a decision is July 3r1, 2023. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from April 191h, 2023 you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

a three (3) slip docking facility at the established pier head line at 2581 Seashore Dr. SW., adj. to the AIWW
in Supply, Brunswick County; And on April 23, 2023, David and Carol Martin proposed to replace & extend
an existing two (2) slip docking facility to the established pier head line at 809 Shoreline Dr. W, adj. to the

degrees 22 minutes East 291.36 feet to the Southwest corner of Lot 13; thence
North 50 degrees 22 minutes East 129.78 feet to the Southeast corner of Lot 13;
thence South 5 degrees 51 minutes West 368.7 feet to the northern line of said
