Dear Mr. Tenorio:
Division of Water Resources' Central and Regional staff has reviewed the application package
received December 16, 2022. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on March 29,
2023.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A through F, or failure to provide the additional information on or before the above requested
date may result in your application being returned as incomplete pursuant to 15A NCAC 02T .0107(e)(2).
Please reference the subject application number when providing the requested information. All
revised and/or additional documentation shall be signed, sealed and dated (where needed), with an

C. Property Ownership Documentation:
1. During review of the application package, it was found that Property Ownership Documentation
was not included for the Wastewater Treatment Facility (Parcel No. 3680152100). Additionally,
the land containing the irrigation areas, monitoring wells, and lagoon are located on a separate
parcel (Parcel No. 3670958317).
Per [15A NCAC 02T .0504(f)], Property Ownership Documentation shall be provided to the
Division by the applicant consisting of:
(1) legal documentation of ownership, such as a contract, deed, or article of incorporation;
(2) an agreement of an intent to purchase the property that is written, notarized, and signed by both
parties, accompanied by a plat or survey map; or
(3) an agreement to lease the property that is written, notarized, and signed by both parties,
indicating the intended use of the property, accompanied by a plat or survey map. Lease agreements
shall adhere to the requirements of 15A NCAC 02L .0107.
➢ Please clarify whether the Applicant has ownership of both parcels referenced above. If ownership
has been established, please provide the deeds to Parcel No. 3680152100 and Parcel No.
3670958317. If only the Wastewater Treatment Facility has been purchased, please provide a lease
agreement for the use of Parcel No. 3670958317.
2. During review of property boundaries and previous permit information, it was also noted that the
most recent land application area map on record is from the July 30, 2013 permit issuance. Since
this permit issuance date, the overall application area has increased from 7.93 acres to 9.34.
Additionally, the resolution of the site map included with the 2013 permit made identifying
landmarks difficult. Compliance with setbacks, as required by [15A NCAC 02H .02190)(5)] at the
time of permitting, cannot be verified.
➢ Please provide a current, higher resolution, map of the residuals land application area so that
setbacks may be accurately assessed, and any required setback waivers may be identified.
