Project Description and History 4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The subject property currently comprised of three different uses: (1) forest land, (2) agricultural land, and (3) developed land (sewer line). The forested communities preent on site consist of both harwood dominated areas, pine dominated areas and mixed pine -hardwood areas. The hardwood dominated areas generally consist of a canopy of sweetgum (Liquidambar styraciflua) , red maple (Acer rubrum) , yellow poplar (Liriodendron tulipifera), and American beech (Fagus grandifolia). The shrub layer is primarily saplings of the canopy species, but also includes ironwood (Carpinus caroliniana), Chinese privet (Ligustrum sinense), and red cedar (juniperus virginiana). The groundcover consists of vines such as Japanese honeysuckle (Lonicera japonica) and wild grape (Vitis rotundifolia) with herbaceous individuals such as Christmas fern (Polystichum acrostichoides), and blackberry (Rubus argutus) also being present. The pine dominated areas are mostly comprised of loblolly pine (Pinus taeda) with sparse shrub and herbaceous layers. The mixed pine -hardwood areas are generally dominated by the the same primary species in the hardwood dominated areas with loblolly pine being a less dominate member of the community. The small agricultural fields on site consist of pasture area. Topography in the area is generally moderately sloped. There are five wetland areas located on site. Four of the wetland areas are located adjacent to tributaries that bisect the site. These small wetland areas consist of a few canopy tree species such as sweetgum (Liquidambar styraciflua), and Ironwood (Carpinus caroliniana). The majority of shrubs are saplings of canopy species. Herbaceous groundcover is dominated by Japanese stiltgrass (Microstegium vimineum), and poison ivy (Toxicodendron radicans). The fifth wetland area is a relatively large wetland area that is located in a "topographic bowl," just west of South New Hope Road. The area collects precipitation and runoff from the surrounding areas and funnels it down gradient until the flow channelized and forms one of the onsite streams. This fifth wetland area is dominated vegetatively by sweetgum and red maple in the overstory. The shrub layer is dominated by silverthorn (Elaeagnus pungens), and the understory is sparse, containing small areas of Japanese stiltgrass. Two jurisdictional streams are located within the subject property. The western- most tributary begins at the large wetland areas and flows off -site before returning onto the property. The eastern -most tributary begins near a property line and flows south until it intersects the western- most tributary (just prior to exiting the southern property boundary. These streams eventually flow into Catawba Creek. General land use in the vicinity of the project is mostly residential development, with some commercial and institutional development areas occurring near the proposed development. Undeveloped areas make up only a minor portion of the overall land area near the project. 4b. Explain the purpose of the proposed project: The growth of the housing market in the greater Charlotte Metropolitan area (seven county area) has been enormous since the end of the "Great Recession." The demand for housing in the area skyrocketed between 2011 and 2022. Since the beginning of 2022, inflation fears have dampened demand for housing in certain areas of the country. Within the Charlotte Metropolitan area, demand for housing has only seen relatively modest declines and still exceeds the current supply. The overall purpose of the project is to design and construct a residential development (Traditional Neighborhood Development (TND)) for this area within the City of Gastonia in order to meet the demand for housing in this quickly growing area of Gaston County (West Charlotte Metropolitan Region) , North Carolina. 4i. Describe the overall project in detail, including the type of equipment to be used: The overall project is designed to be a "Traditional Neighborhood," meaning that the site will contain both single family and multi -family residential features, as well as some commercial/retail, all within the confines of the project. Along with existing features in the vicinity, the site will form the core of a neighborhood concept that the City of Gastonia is keen to create. The site will have three permanent jurisidictional impacts (2 tributary crossings for access and one wetland fill area for infrastructure). There will also be temporary impacts associated with the stream crossings (pump around activities for construction of the culverts), and for the construction of the retaining wall within the wetland area. The equipment that will be used during the construction of this site will include, but is not limited to: bulldozers, excavators, heavy trucks, and similar equipment used in heavy construction. 4j. Impact Justification and Mitigation 1. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts through project design: During the initial design efforts, several configurations were evaluated for lot efficiency and environmental impact. The first draft of a sketch plan initially had approximately 1,100 linear feet of stream impact and 0.73- acre of wetland impact proposed for the project. The engineer and developer both agreed that the impacts were too great and that a plan could be derived on this site that met the overall purpose and need for the site, while minimizing impacts to jurisdictional areas and reducing the potential mitigation costs associated with any permitted impacts. A second draft of the sketch plan was successful in somewhat reducing impacts to the Stream A (drains to Catawba Creek) by reducing the number of roads and lots that would affect Stream A, reducing the overall stream impacts to ±1,100 linear feet for the site and wetland impacts down to 0.73-acre for the site. Again, the engineer and developer both agreed that the impacts were still too great and that a plan could be derived on this site that met the overall purpose and need for the site while further minimizing impacts to jurisdictional areas and reducing potential mitigation costs. The final plan, which is presented as the preferred plan (Engineering Drawings) reduced permanent impacts to Stream A down to 136.7 linear feet (0.013-ac) for a single road crossing. The permanent impact to the wetland at the head of Stream A was reduced down to 0.464-acre through the use of a retaining wall. The impact to Stream C was also reduced down to a smaller road crossing with a permanent stream impact of 60.6 linear feet (0.006-ac) through the use of larger headwalls. 1 b. Federal and State Threatened and Endangered Species Evaluation The USFWS iPac official species list indicates five species with the potential to inhabit the Wilson site. Those 5 species include: Tri-colored bat (Perimyotis subflavus), Monarch butterfly (Danaus plexippus) , Bog turtle (Glyptemys muhlenbergii) , Dwarf -flowered heartleaf (Hexastylis naniflora) , and Schweinitz's sunflower (Helianthus schweinitzii),. LEES evaluated the project study area for potential habitat for two of these federally listed Threatened (T) or Endangered (E) species that occur on the official species list downloaded from USFWS: (1) Schweinitz's sunflower, and (2) Dwarf - flowered heartleaf. The other three species were not included in the evaluation for the following reasons: (a) Monarch butterfly was not included in the evaluation because it is only considered a candidate species for listing and does not require Section 7 consultation; (2) Bog turtle is considered Threatened due to similarity of appearance, which does not require Section 7 consultation; and (3) Tri-colored bat is listed as Proposed Endangered, which does not require Section 7 consultation, currently. The habitat evaluations/surveys took place in late April 2022 for Dwarf -flowered heartleaf and in October 2022 for Schweinitz's sunflower. Habitat evaluation/surveys consisted of pedestrian transects across the forested portion of the project site for Dwarf -flowered heartleaf. Habitat evaluations/surveys for Schweinitz's sunflower concentrated along all easements/rights of way (mainly sewer and roadsides, along with three open fields/field edges Dwarf -flowered heardeaf (T), Dwarf -flowered heartleaf typically occurs in Piedmont uplands on sandy -loam, acidic soils that are generally somewhat deep and moderately permeable. North facing aspects are also a favorite of Dwarf -flowered heartleaf. Typical habitats for this species include mesic to dry bluffs, slopes, or ravines in deciduous forests that are commonly associated with LOWRYS ENVIRONMENTAL & ECOLOGICAL SERVICES, LLC April 20, 2023 Page 2 mountain laurel or in moist soils within the floodplains of small creeks or streams. Sometimes they can be found along lakesides and larger rivers. Based on the habitat evaluations/surveys conducted across the forested portions of the subject property, habitat potential would be considered marginal across the site. The vegetation is dominated by hardwoods with small areas of mixed pine -hardwood. Understories were relatively open with some undergrowth of shrubs and smaller saplings and seedlings. One species of Hexastylis was located in several places on site, common heartleaf (Hexastylis arifolia). The surveys/evaluations conducted did not reveal any occurrences of Dwarf -flowered heartleaf. Additionally, the NCNHP records indicated no documented occurrences of this species within 1.0 mile of the project site. Further review of the database noted that the closest known population is located approximately 9.5-miles to the southwest of the site. Since the habitat is considered to be marginal, we would recommend a biological conclusion of, may affect, not likely to adversely affect, even though, no individuals were located on -site during the surveys/evaluations. Biological Conclusion: May affect, not likely to adversely affect Schweinitz' sunflower (E) tends to grow in soils that are thin, and generally occur on upland interstream flats or gentle slopes, on soils that are clayey in texture, and, when weathered from metasedimentary rocks, often contain large quantities of slaty rock fragments. This species also inhabits generally open areas, with abundant sunlight and little competition from other vegetation. The majority of the project site is forested and has been for many years. There are three cleared fields that would provide habitat along the field edges (fields are mainly maintained pastures). Additionally, there were access roads to the fields, as well as sewer line easement that also provides potential habitat for Schweinitz's sunflower. These areas were evaluated/surveyed during October 2022. The habitat potential for these areas would be considered marginal at best, due to the fact that the field edges and roadsides/sewer easements are relatively maintained, and the edges are quite thick with vegetation. During the systematic survey of these areas, no individuals of Schweinitz's sunflower were observed. The NCNHT records review indicated that there are no populations that occur within a one -mile radius of the subject property. Further investigation of the NCNHP database noted that the closest known population is approximately 3.5 miles to the southeast. However, since the habitat is considered to be marginal, we would recommend a biological conclusion of, may affect, not likely to adversely affect, even though, no individuals were located on -site during the surveys/evaluations. Summary Habitat potential for both Dwarf -flowered heartleaf and Schweinitz's sunflower would be considered marginal.
