The Division of Water Resources (Division) received your request to rescind Special Order by
Consent (SOC) S17-005 Ad, II on April 21, 2023.
Based on information provided in the rescission request and during a virtual meeting on March 14,
2023, staff from the Central and Regional offices concur with your request. Accordingly, the Division has
rescinded SOC S 17-005 Ad, II, effective immediately. The Division also denies your application for a third
amendment to SOC S17-005, which was received September 14, 2022.
Currituck County remains responsible for complying with all requirements of Non -Discharge
Permit No. WQ0035796. Please be advised that the Division may pursue additional enforcement actions
for any future violations of the permit or State law. If you need additional information concerning this letter,
