Sullins Director September 30, 2011 Mr. David F. Moody, Assistant Superintendent Chatham County Schools P. O. Box 128 Pittsboro, NC 27312 Subject: Issuance of NPDES Permit NC0039471- Bennett Elementary School WWTP Chatham County Dear Mr. Moody: Dee Freeman Secretary Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This final permit includes one significant change from the draft permit sent to you on August 3, 2011. This addition was made after the Division'received comments regarding the reissuance of the permit from the North Carolina Wildlife Resources Commission (NCWRC). The NCWRC expressed its concern regarding both ammonia nitrogen limits for this facility and the ammonia nitrogen concentrations being discharged into the receiving stream as depicted on self -monitoring reports. Such concentrations may be harmful to endangered and protected aquatic species known to populate this portion of the Cape Fear River Basin. As a result, condition A. (4.) has been added to the final version of the permit, a condition that states the permit may be reopened to impose increased monitoring frequencies and/or stricter effluent limitations for ammonia nitrogen in the event that the facility exhibits consistent noncompliance with the established effluent limits. You are reminded of the following changes in this permit from the terms and conditions found in the previous permit, as were noted in the letter accompanying the draft permit: • Parameter codes have been added to :the list of characteristics to be monitored. • A condition has been added regarding the monitoring, reporting and compliance determination of Total Residual Chlorine values in the event that. the ultraviolet disinfection system fails and chlorine compounds are used for disinfection. • A reopener condition has been added regarding the potential to require additional nutrient monitoring to support water quality modeling efforts within the Cape Fear River basin. 1617 Mail Service Center, Raleigh, North Carolina 27699-1617 1TOn.,e,1, Location: 512 N. (2.) TEMPORARY MEANS OF DISINFECTION In the event that the wastewater treatment plant's ultraviolet (UV) disinfection system should fail, underperform, or otherwise be removed from effective service, the permittee or his agent should immediately inform the Surface Water Protection Section staff of the Raleigh his Office of this development and discuss temporary, alternate means for disinfection of the effluent. If chlorine compounds are used as temporary means of disinfection, the total residual chlorine (TRC) concentration of the effluent must be monitored on a daily basis while this method of disinfection is in use and values must_ be reported on the discharge monitoring report. TRC in the effluent may not exceed 17 µg/L; therefore, dechlorination methods may also be necessary to ensure protection of water quality in the receiving stream. In the event that TRC monitoring should occur, the Division shall consider all effluent TRC values reported below 50 µg/L to be in compliance with the permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina certified laboratory (including field certified), even if these values fall below 50 µg/L. Use of a disinfection system other than the permitted UV system during circumstances not deemed as emergency and/or temporary (replacement of lamps, lamp cleaning or maintenance, etc.) will be considered a violation of the terms of this permit. A. (3.) PERMIT RE -OPENER: NUTRIENT MONITORING Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in the North Carolina Administrative Code at 15A NCAC 211.0112 (b) (1) and 2H.0114 (a) and Part II sections B- 12 and B-13 of this permit, the Director may reopen this permit to require supplemental nutrient monitoring of the discharge. The purpose of the additional monitoring will be to support water quality modeling efforts within the Cape Fear River Basin and shall be consistent with a monitoring plan developed jointly by the Division and affected stakeholders. In addition, the results of water quality modeling may require that limits for Total Nitrogen and Total Phosphorus be imposed in this permit upon renewal. A. (4.) PERMIT RE -OPENER: AMMONIA (NH3 as N) NONCOMPLIANCE To help ensure the viability of habitat for endangered species and species of special concern known to live within the portion of the Cape Fear River Basin where this discharge occurs, in the event that the facility exhibits consistent noncompliance with permit effluent limits for ammonia nitrogen, the permit may be reopened for the purpose of imposing increased monitoring frequencies and/or stricter effluent limitations for this parameter. For the purposes of this section, consistent noncompliance shall be defined as any noncompliance with effluent limitations (monthly average or daily maximum limits) that occurs during three consecutive months or during any four of six consecutive months. ® North Carolina Wildlife Resources Commission KN Gordon Myers, Executive Director ►(e77•1111110051 TO: Bob Sledge, Surface Water Protection Section — Point Source Branch Division of Water Quality Q FROM: Shari L. Bryant, Piedmont Region Coordinator Habitat Conservation Program DATE: 31 August 2011 SUBJECT: Draft NPDES Permit for Chatham County Schools, Bennett Elementary School WWTP, Chatham County, NPDES Permit No. NCO039471 Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject . document. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), North Carolina General Statutes (G.S. 113 -13 1 et seq.), and North Carolina Administrative Code 15A NCAC 101.0102. Chatham County Schools has applied for a renewal of their NPDES permit to discharge treated wastewater into Flat Creek. Bennett Elementary School WWTP is a 0.005 MGD facility that uses ultraviolet light for disinfection. The monthly average ammonia -nitrogen (NH3 as N) limit is 2.0 mg/L for April 1-October 31, and 4.0 mg/L for November 1-March 31. The daily maximum ammonia -nitrogen limit is 10 mg/L for April 1-October 31 and 20 mg/L for November 1-March 31. Flat Creek is a tributary to Deep River in the Cape Fear River basin. There are records for the federal species of concern and state special concern Carolina darter (Etheostoma collis) in Flat Creek. In addition, there are records for the federal and state endangered Cape Fear shiner (Notropis mekistocholas); the federal species of concern and state endangered yellow lampmussel (Lampsilis cariosa) and brook floater (Alasmidonta varicosa); the federal species of concern and state threatened Carolina redhorse (Moxostoma sp.); and the state threatened triangle floater (Alasmidonta undulata) and creeper (Strophitus undulatus) in Deep River. We are pleased to see the facility uses ultraviolet disinfection and the provisions regarding the use of chlorine for temporary disinfection included in Section A. (2.). However, we are concerned about ammonia -nitrogen in the effluent and its impact on aquatic resources. A review of reported ammonia - nitrogen in the effluent showed that between April 2008 and May 2010 the facility exceeded its monthly average limit on 15 occasions and its daily maximum limit on 4 occasions. It appears the facility is capable of removing ammonia -nitrogen from the effluent. For example, in May 2010, the reported minimum was 0.13 mg/L, the maximum was 0.59 mg/L and the average 0.36 mg/L. Mailing Address: Division of Inland Fisheries m 1721 Mail Service Center • Raleigh, NC 27699-1721 Telephone: (919) 707-0220 • Fax: (919) 707-0028 Page 2 31 August 2011 Bennett Elementary School WWTP NPDES Permit No. NCO039471 Fish and mussel species are very sensitive to ammonia. Dwyer et al. (2005) found that Cape Fear shiners had an IC25 of 8.8 mg/L for ammonia. An IC25 is the level at which an organism exhibited a 25 percent reduction in a biological measurement such as reproduction or growth after a 7-day exposure. Also, freshwater mussels are one of the most sensitive aquatic organisms tested for impacts from ammonia. Augspurger et al. (2003) found that ammonia concentrations which may be protective of freshwater mussels range from 0.3 to 1.0 mg/L total ammonia as N at pH 8. Should the permit be issued, we offer the following recommendations to minimize impacts to aquatic resources and in particular to listed species. Daily maximum ammonia -nitrogen limits (NH3 as N) of no more than 6.0 mg/L (April 1-October 31) and 12.0 mg/L (November 1-March 31). 2. More frequent monitoring of ammonia -nitrogen (e.g., two times per week). We are concerned that monitoring twice per month is not sufficient for documenting compliance or for identifying malfunctions in the facility's equipment. If not already in place, we suggest the installation of a stand-by power system. Connect the facility to a municipal wastewater system if one is available. If a municipal wastewater system is not available, then upgrade the facility to improve reliability to ensure that it remains in compliance with all permit limits. Thank you for the opportunity to comment on this draft permit. If we can be of further assistance, please contact our office at (336) 449-7625. Literature cited: Augspurger, T., A.E. Keller, M.C. NC0026671, Elizabethtown WWTP (permit assigned to Jim M.) —No action recommended. Problems seem to be resolved. 3. NC0058548, Star WWTP (permit assigned to Jim M.) — No action recommended. Problems caused by a lack of flow to the plant (loss of industry). 4. NC0061719, Woodlake Country Club WWTP (permit assigned to Maureen S.) — No permitting action recommended. This is an older plant that does not have a clarifier. The operators would like a small clarifier added to the treatment plant, but the owners will not make the purchase. Region feels this would be a good candidate for an Administrative Order (Special Order without Consent). 5. NC0064521, Erwin WWTP (permit assigned to Jim M.) — No permitting action recommended. Major 1/1 work has been done at the plant. It is scheduled to close and tie in to the North Harnett regional plant in the next few years. Region feels this would be a good candidate for an Administrative Order (Special Order without Consent). 6. NC0072877, Newton Grove WWTP (permit assigned to Maureen S.) — No action recommended. This is a well operated, 100% domestic plant. Good compliance during the past year. Cape Fear River Basin - 2011 2 Proposed NPDES Permitting Actions for Permit Renewals RRO 1. NC0074446, Hilltop MHP WWTP (permit assigned to Bob S.) — see region WARO NC0020575, Mount Olive WWTP (permit assigned to Jackie N.) — No action recommended. However, the permit writer may want to follow-up with the region to ascertain any new developments post the region's planned site inspection. The permit was modified years ago to address the non-compliance issues. Currently, the town is in litigation with its consulting engineering firm regarding the design & oversight of the construction project. WIRO 1. NC0003344, Wallace Chicken Processing Plant (permit assigned to Jim M.) —This facility is under a Judicial Order by Consent. Recommend referencing the JOC in the renewed permit. 2. NC0020346, Magnolia WWTP (permit assigned to Maureen S.) — No action recommended. Compliance problems relate to plant design flaws and construction issues. For the most part, issues have been resolved or a work -around established. Permit writer may want to follow-up with the region. 3. NC0020702, Wallace WWTP (permit assigned to Ron B.) — No action recommended. Past compliance issues attributed to poor O&M by the old ORC. Facility is now operating under an SOC and a new plant is under construction. Plant has 1/1 issues that should be resolved with the new plant. 4. NC0056863, Rose Hill WWTP (permit assigned to Jackie N.) — Special condition requesting a solids depth survey and submittal of a plan for solids removal; follow-up with the region. Lack of proper 0&M (ex., solids volume maintenance and proper oversight of treatment volume/detention in the oxidation ditch) is attributed to compliance issues. Because the facility is classified as a major, need to consider increasing monitoring frequency and adding daily limit requirements. Currently, influent monitoring is controlled by the effluent meter. Need a special condition inserted in renewed permit that upon expansion or significant upgrade that this issue is addressed. FACT SHEET FOR EXPEDITED PERMIT RENEWALS This form must be completed by Permit Writers for all expedited permits which do not require full Fact Sheets. Expedited permits are generally simple 100% domestics (e.g., schools, mobile home parks, etc) that can be administratively renewed with minor changes, but can include facilities with more complex issues (Special Conditions, 303(d) listed water, toxicity testing, instream monitoring, compliance concerns).
