Subject: Modification to NPDES Pemait
Permit No. NCO039420
Virginia DOT 1-77 Rest Area
Surry County
On June 30, 1994, the Division of Water Quality issued NPDES Permit No. NCO039420
to Virginia Department of Transportation. Based on a review of this permit file by the Aquatic
Survey'and Toxicology Unit, the Division is hereby forwarding the following modification to the
subject permit. This permit modification is to remove the toxicity testing requirement from the
effluent limitations page and Special Condition Part IH E (chronic toxicity). Please insert the
enclosed effluent limitations page and discard the old effluent limitations page. This permit
modification becomes effective immediately.
All other terms and conditions in the original permit remain unchanged and 'in full effect.
These modifications are issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U. S.
Environmental Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit
are unacceptable to you, you have the right to, an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the�'
Office of Administrative Hearings, Post Office Drawer 11666, Raleigh, North Carolina 27604.
Unless such demand is made, this decision shall be final and binding.

NH3 as N limits of 6.0 mg/l monthly average in summer (April 1 - October 3 1) and 22.0 mg/1 monthly average in winter (November 1 -
March 3 1) shall become effective on May 1, 1996.
The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored 2/month at the effluent by grab
sample.
There shall be no discharge of floating solids or visible foarn in other than trace amounts.
