Dear Mr. Kostro:
Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994 (or
as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on December 8,
2004.
It has been noted that your facility is in the progress of connecting to the water and sewer system
of the City of Mt. Airy. Once you cease discharging, please submit to the Division a request to rescind
this permit. A rescission will stop all permit requirements and annual fees, as well as your legal right to
discharge wastewater from this facility.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect the
legal requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required. If you have any questions concerning this

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of this permit
issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive authority to

Thank you for your email.
As noted in your email the Carroll County Welcome Center currently does not have a
dechlorination system. However, a contract, dated December 4, 2002, had been
implemented for design, permitting, and construction for a wastewater dechlorination
facility, to ensure compliance with NCDENR. This project had just completed the
testing phase and was currently in the design phase of the project.
However, as noted in my email to you on September 14, 2004, although plans are
currently underway for a new wastewater dechlorination facility, The Department
anticipates completion of the project between North Carolina and Mount Airy to
connect the welcome center to a water and sewer system prior to the effective date of
February 2006. Completion of this project would eliminate the need for a
dechlorination facility or the new effluent limit. If for any reason the project incurs
any delay that may prevent project completion by the effective date, the Department
will submit a formal written request for an extension.
Based on this information it is my understanding that modifications will be made to
the permit to allow an 18- month compliance schedule. In addition to the permit
modifications, the Notice of Violation dated November 9, 2004 from the North .
Carolina's Division of Water Quality and assessment of civil penalty in the amount of
$1,094.00 will be waived.
I truly appreciate all of your assistance on this matter. If further correspondence is

Hi Allen,
I've checked the permit file and spoken to the Regional Office- it appears that
the TRC limit was enforced because there was no 18-month compliance
schedule in the draft permit. The reason we left out the compliance schedule is
because the permit application states that the facility already provides
dechlorination. The 18-month schedule is intended to give a facility time to
construct a dechlorination system, and it was assumed that the Rest Area
would not require additional construction.
During our conversations you explained that the rest area does not currently
provide dechlorination, and that VA DOT would have needed to construct
additional treatment units to provide dechlor. If that is correct, then I can
modify the permit to give you the 18- month compliance schedule and have the
region dismiss the NOV. This would be a minor modification that would take
effect within the next week or two.
If this sounds good to you, let me know (via email preferably so that I can stick
a note in the file). We'll try and get it straightened out as soon as possible.

The Division of Water Quality (DWQ) of the North Carolina Department of Environment and
Natural Resources (NCDENR) has advised VDOT, by letter dated October 4, 1999, that a new
effluent limit for total residual chlorine (TRC) will be imposed on the discharge from the WWTP
serving the I-77 Welcome Center in Carroll County, Virginia, which discharges in Surry County,
North Carolina. Effective with the re -issuance of the permit the TRC limit, shall be no greater
than 28 ug/l.
A contract, dated December 4, 2002, for Professional Services between the Department and
Thomas Koontz, Architect, PC was implemented for design, permitting, and construction
administration for a wastewater dechlorination facility, to ensure compliance with NCDENR.
The project began in January 2003 and was anticipated to be complete by June 30, 2004.
However, the engineering firm did not begin the pilot testing until April 22, 2004. This lengthy
delay is due to issues related to the use of the portable colorimeter. The colorimeter is needed to
measure the effectiveness of using tablet dechlorination by monitoring the very low levels (10-15
micrograms per liter range) of total residual chlorine (TRC).
According Mr. Jim Billups of Anderson and Associates (Thomas Koontz subcontractor) the pilot
testing report would be complete by July 2, 2004. Design documents, construction drawings and
specifications with a permit application would be submitted to NCDENR by July 31, 2004.
Provided there are no delays by NCDENR the project should be ready to bid the work by
September 15, 2004. The scope will be very small, so work should commence by October 15,
and be complete by December 1, 2004.
As per our conversation on July 13, 2004, it is my understanding that the TRC limits would go
into effect 18 months after the re -issuance of the permit (February, 2006). Also in our
discussions, I stated that VDOT, the North Carolina Department of Transportation and the City
of Mount Airy were currently initiating a project to connect the referenced rest area to Mount
Airy's water and sewer system. In our discussion we both agreed that if this project could be
completed by February 2006, then there was no need to move forward with a wastewater

dechlorination facility because the water and sewer connection would be made before the TRC
limits were to go into effect. VDOT will not officially discontinue this project until we have
received written concurrence with the plans detailed in this letter from your office.
Based on VDOT's intent to connect the Carroll County rest area to city sewer and water, it is our
determination to discontinue with the dechlorination project. The Department will continue to
monitor discharge from the WWTP serving the I-77 Welcome Center in accordance with the
NCDENR permit regulation until connections are made.
