On April 29, 2015, at the request of Ed Foley of Parker and Associates, Inc., Joanne Steenl
the Division of Water Resources (DWR) Wilmington Regional Office (WiRO) went to the si
determine the ephemeral /intermittent (E /1) points of streams, as well as the presence or
of a stream at the Jacksonville Commons Area Tract. The enclosed drawing depicts the E,
and whether a feature has been determined to be a stream or not. This drawing has bee
and is valid for 5 years.
This on -site determination shall expire five (5) years from the date of this letter. Lando
other affected parties that dispute a determination made by DWR or a delegated Local
Authority may request a determination by the Director. An appeal request must be ma
within sixty (60) calendar days of the date of this letter or from the date the affected pi
(including downstream and /or adjacent owners) is notified of this letter. A request for
determination by the Director shall be referred to the Director in writing c/o Karen Higl
DWR 401 & Buffer Permitting Unit, 1617 Mail Service Center, Raleigh, NC 27699 -1617.
This determination is final and binding unless, as detailed above, you ask for an appeal
sixty (60) calendar days.
The owner /future owners should notify the Division (including any other local, state and
agencies) of this determination concerning any future correspondence regarding the sub
property. This project may require a Section 404 Permit /401 Water Quality Certification
