This application includes the impacts to one isolated wetland pocket as well as non- isolated wetland/waters impacts as indicated on the plan. As proposed, total wetland impacts would be equal to 0.275 acres and total open water impacts would equal 0.084 acres. The open water (fresh) impacts are associated with the proposed dam repairs. Mitigation for the necessary impacts to 404 wetlands associated with the repair of the 3 existing dams will be the preservation of all remaining riparian and non-riparian wetlands including all coastal wetlands on the property. Wetland preservation will be accomplished through the recordation of restrictive covenants (see PCN attachment) referencing these wetlands while allowing for the maintenance of the dams and community pier. The project is located on the Intracoastal Waterway, Shallotte, Brunswick County, North Carolina. Proposed work located within the 75' AEC includes the repair of the lower dam, construction of two townhomes and the subject pier and docking facility. Previous permits for the site include Stormwater Permit No. SW8 070544 and Erosion and Sedimentation Control Permit No. Bruns-2008-031. These impacts are the consequence of the proposed reconsh•uction of three failin~~ earthen dams. The permanent impact is due to proposed till material necessary to provide a stable structure, while the temporary impact is necessary to provide access for the construction of the improvements, as shown on shown in the submittal documents. Effort will be made to minimize the extent of the temporary impacts. The d~u-ation of construction is anticipated to be approximately ~0 days. No person or entity shall perform any of the following activities on such conservation area: a. fill, grade, excavate or perform any other land disturbing activities b. cut, mow, burn, remove, or harm any vegetation c. construct or place any roads, trails, walkways, buildings, mobile homes, signs, utility poles or towers, or any other permanent or temporary structures d. drain or otherwise disrupt or alter the hydrology or drainage ways of the conservation area e. dump or store soil, trash, or other waste f. graze or water animals, or use for any agricultural or horticultural purpose Specifically exempted activities are: A. The cutting and removal of stone-damaged or diseased trees. B. The construction of elevated, slatted wooden boardwalks no more than 6' wide. C. Maintenance and repair of the man-made dams on site. D. Maintenance and repair of the community boating facility. E. Emergency fire response work. This covenant is intended to ensure continued compliance with the mitigation condition of a Clean Water Act authorization issued by the United States of America, U.S. Army Corps of Engineers, Wilmington District, Action ID ,and therefore maybe enforced by the United States of America. This covenant is to run with the land, and shall be binding on the Owner, and all parties claiming under it." Usually, restrictive covenants have a provision that the property owners (either all of them or some percentage of them) can amend or modify the restrictive covenants. If that is the case, that provision needs to provide that our required paragraph (usually identified by paragraph number) cannot be amended without the express written consent of the U. S. Army Corps of Engineers, Wilmington District. The stormwater control has been designed to handle the runoff from a total of 832,579 square feet of impervious area. 4. During construction, erosion shall be kept to a minimum and any eroded areas of the system will ba repaired immediately. 3, The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permifi, the approved plans and specifications, and other supporting data. 4. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 5, The permittee shall at all times provide the operation and maintenance necessary to assure the permitfied sfiormwater system functions at optimum efficiency. The approved ©peration and Maintenance Plan must be followed in its enfiirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. c. Mowing and revegefiation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Mainfienance of aU slopes in accordance with approved plans and specifications. f. Qebris removal and unclagging of bypass structure, filter media, flow spreader, catch basins, piping and vegetated filter, g. A clear access path fio the bypass structure must be available at all times. 6. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records wiq indicate the date, activity, name of person performing the work and what actions were taken, 7. Upon completion of construction, prior to issuance of a Certificate of dccupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the System tnstalled certifying that the permitted facility has been installed in accordance with this permit, fihe approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. Access to the stormwater facilities sha11 be maintained via appropriate easements afi al! times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculafiions prior fio construction, for any modification to the approved plans, 'including, but nofi limited to, those listed below: a. Redesign or addition to the approved amount of built-upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years Pram the date of the completion of construction. 12. The Director may notify the permittee when the permitted site does not meet one or mare of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shat) submit a written time schedule to the Director far modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in wrifiing to the Directar that the changes have been made. 13. Prior to the sale of any lot, the fallowing deed restrictions must be recorded; a. The following covenants are intended to ensure ongDing compliance with State Stormwater Management Permit Number SW$ 1370544, aS issued by the Division of Wat®r Quality under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. c. These covenants are to run with the land and be binding on all persons and parties claiming under them. d. The covenants pertaining to Starmwater may not be altered or rescinded without the express written consent of the State of North Carolina, pivision of Water Quality, e. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Water Quality. The maximum built-upon area per lot is 2,500 Square feet for 133 single family lots, 1,525 square feet for 54 townhome units, and 1,725 square fast far 45 townhame units, This allotted amount includes any built~upan area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but iS not limited ta, structures, asphalt, concrete, graveE, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surFace of swimming pools. g. Lofts within CAMA's Area of Environmental Concern may be subject to a reduction in their allowable built-upon area due to LAMA regulations. h. All runoff on the lot must drain into the permitted system, This may be accomplished through providing roof drain gutters which drain to the sfireet, grading fihe lot to drain toward the street, ar grading perimeter swales and directing them into the pond ar street. Lots that will naturally drain into the system are not required to provide these extra measures. Built-upon area in excess of the permitted amount will require a permit modification. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the dafie of recording the plat, and prier to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. III. GENERAL Ct~NpITIQNS 1. This permit is not transferable except after notice to and appproval by the Director. In the event of a change of ownership, or a name change, tl~e permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as ma be appropriate. The approve( of this request will be considered on its merits and may or may not be approved. The permittee is responsible far compliance with ail permit conditions until such time as fihe Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.60. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulafiions, or ordinances, which may be imposed by other govemmenfi agencies (local, state, and federal) having jurisdiction, 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this pivision, such as fihe construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting ail components of fihe permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a re uest for a permit modification, revocation and reissuance or termination ~oes not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in fihe North Carolina Erasion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications far this project are incorporated by reference and are enforceable parts of the permit. 9.
