John E Skvarla, III Secretary Ifi MAY 1 2 2015 J DENR - WATLR 6tE�0UFtCi -S Enclosed are live copies of a completed application submittal package requesting a Water Quality Certification (No 3883) which corresponds to US Army Corps of Engineers (USAGE) Nationwide Permit 3 This application package consists of the following documentation- a completed PCN form, two maps, construction drawings, Journal transfer in the amount of $240 to the Division of Water Resources and other agency approval letters. The primary purpose of this project is to replace an existing culvert which has failed and is creating erosion issues on the trail The pievious culvert was undersized and had blown out due to a recent flooding event. The proposed replacement is larger and will be reinforced with np rap to adequately handle the amount of water that will flow through this stream The culvert material will be changed to corrugated metal to handle the prescribed fire regime in this region 7 he project site was visited in July 2014 by USACE Tyler Crumbley who determined that impacts would be limited to stream bed and no wetlands were impacted He did request a PCN to be sent to USACE because of the project sites proximity to both Red Cockaded Woodpecker habitat and a National Register Histonc Area The correspondence from both State Historical Preservation Office and U S. Dodson, Jr, Piedmont Region Biologist, DPR Natural Resources Program (via electronic mail dated July 22, 2014) regarding the proposed replacement of a culvert in the Long Valley Farm Unit of Carver's Creek State Park. The culvert supports a road that is the only access to the northwest portion of the park by vehicle. The project occurs within suitable habitat for the federally endangered red - cockaded woodpecker (Pieoides borealis; RCW). Our comments are provided in accordance with section 7 of the Endangered Species Act (Act) of 1973, as amended (16 USC 1531 et seq.). N.C. State Parks staff provided additional information regarding the proposed culvert replacement to Ms. Susan Miller of the Service's Sandhills sub - office during a site visit on January 27, 2015. Installation of the new culvert would not require the removal of any pine trees. Based on information available to the Service, the closest active RCW cluster is over 1,500 feet north of the project site. Construction activities would not result in loss of suitable habitat for the RCW nor would the project cause harassment of woodpecker groups. The project site occurs within an area known to contain a sensitive plant species, Cuthbert's turtlehead (Chelone cuthbertii). Cuthbert's turtlehead is a not a federally protected species but is considered a federal species of concern and is regarded by the State of North Carolina as "Special concern- vulnerable" species. When replacing the culvert, we encourage State Parks to use practices that minimize impacts to this species. It may be desirable to contact the State Plant Conservation Program in the event that disturbance would displace a significant portion of the plants in the site. Based on a review of the information provided, the Service believes that the proposed project is not likely to adversely affect the RCW. We believe that the requirements of section 7(a)(2) of the Act have been satisfied. We remind you that obligations under section 7 consultation must be reconsidered if (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. We understand the Division of Parks and Recreation would like to replace an existing culvert with a 42" galvanized corrugated pipe, along the Cypress Point Loop Trail at Carvers Creek State Park. The project area lies within the boundaries of the National Register -listed Long Valley Farm (CD0200). However, we feel replacing an existing culvert with a larger one to prevent sink holes and further erosion of the trail will not adversely affect the historic property or its contributing elements which are not within view of the project area.
