POST OFFICE BOX 146 RONDA, NORTH CAROLINA 28670-0146 Dear Mr. Key: NORTH CAROLINA Environmental Quality April 25, 2023 Subject: Permit No. WQ0037135 U.S. Biosolids Class B Residuals Program Attachments A & B Certification Wilkes County In response to your permit major modification request received on December 14, 2022, and subsequent additional information received on March 20, 2023, we are forwarding herewith modified Attachments A and B certified April 25, 2023, to U.S. Biosolids, Inc. for the subject program. Modifications to the subject Attachments are as follows: ➢ The Division has added the Town of Dallas WWTP (Permit No. NC0068888) as an approved residual source, with an approved annual dry tonnage of 100 dry tons per year (DT/yr). ➢ The Division has reduced the acreage for Field NC-GA-ME-02-05 from 24.60 acres to 23.70 acres making the total acreage for the permit 490.17 acres. The modified Attachments A and B are effective from the date of certification until September 30, 2024, shall replace Attachment B of Permit No. WQ0037135 issued on July 23, 2020, and Attachment A that was previously certified on August 9, 2022, and shall be subject to the conditions and limitations therein, as well as those specified in the above -referenced permit. Please replace Attachment B of Permit No. WQ0037135 that was issued on July 23, 2020, and Attachment A that was certified on August 9, 2022, with the modified Attachments A and B. The Permittee shall submit a renewal application no later than April 3, 2024. This certification can be contested as provided in Chapter 150B of the North Carolina General Statutes by filing a Petition for a Contested Case Hearing (Petition) with the North Carolina Office of Administrative Hearings (OAH) within 30 calendar days. Requirements for filing a Petition are set forth in Chapter 150B of the North Carolina General Statutes and Title 26 of the North Carolina Administrative Code. Those interested in filing may access additional information regarding the requirements for filing a Petition and Petition forms at the OAH website or by calling the OAH Clerk's Office at (919) 431-3000. A party filing a Petition shall serve a copy of the Petition on the Department of Environmental Quality's Office of General Counsel at 1601 Mail Service Center, Raleigh, NC 27699-1601. Analyses to demonstrate that the residuals are non -hazardous (i.e., TCLP, ignitability, reactivity, and corrosivity) as stipulated under permit Condition IV.2. 3. Testing of metals and nutrients as stipulated under permit Condition IV.3. 4. Analyses of the pathogen and vector attraction reductions as stipulated under permit Condition IV. 4. 5. Class B non -biological residuals are exempt from meeting the pathogen and vector attraction reduction requirements in Condition IVA. provided the Permittee does not mix them with residuals generated during the treatment of domestic wastewater, the treatment of animal processing wastewater, or the biological treatment of industrial wastewater. The Permittee shall treat and process Class B non -biological residuals in a manner as not to meet the definition of "Biological Residuals" as defined in 15A NCAC 02T .1102(6). 6. Monitoring frequencies are based on the actual dry tons applied per year using the table below unless specified above.
