4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: "
Friendship Chapel Road is currently stubbed to dead end just east of Dunn Creek. The Dunn Creek crossing area currently consists of a mostly open floodplain with a greenway trail and
sanitary sewer easement.
The Reserve at Dunn Creek subdivision assemblage consists of three parcels of land predominately planted in a loblolly pine stand with hardwood buffers along Dunn Creek and Spring
Branch. The property is bordered on the north by the Highway 98 bypass, to the east & southeast by Heritage residential subdivision and newly constructed Legacy apartments (both
across Dunn Creek), and to the west & southwest by the newly constructed Holden Village subdivision.

" These approvals expired. The applicant has reduced the impacts notably for the Friendship Chapel Road crossing of Dunn Creek (aka Hatters Branch) considerably to stay below the
0.05 acre stream loss threshold of the new NWP14. The Reserve at Dunn Creek subdivision has been further designed and all anticipated impacts are now requested in this application
along with the renewal request for the Friendship Chapel Road crossing of Dunn Creek.

The project purpose is to construct a residential subdivision on land that is landlocked by Dunn Creek, Spring Branch & Highway 98 Bypass.

The project consists of a residential subdivision, extension of the existing Friendship Chapel Road across Dunn Creek to the project, sanitary sewer connections, stormwater SCM
conveyances, and greenway trail connections to the east and west. No indirect impacts are anticipated from the development which will obtain all necessary FEMA, stormwater & erosion
control permits. Equipment used will be heavy earth moving equipment such as bulldozers and excavators typically used in such civil construction projects.

near Spring Branch which were identified & will be avoided, but we were unable to find a JD for these flags, the applicant was able to easily avoid them;

Friendship Chapel Road will eventually be extended to the west which will complete the road from South Main Street to Heritage Lake Road. The Town of Wake Forest will be applying for
crossing. The Reserve at Dunn Creek project was required to stub Friendship Chapel Road to align with the existing stubbed section within Holding Village.

purchased in March 2022 which is 10,072 credits more than the 53,869 credits that are now required;

E. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
The project was previously permitted by the USAGE and DWR in 2020. Only buffer mitigation was required for those impacts. The impacts have not yet
occurred and the associated NWP has expired. The applicant retained S&EC to renew the Neuse Buffer determinations (which also expired) and to
confirm that there have been no changes to the potentially jurisdictional wetlands and streams. S&EC worked with the applicant and their engineers to
revise the Friendship Chapel Road crossing of Dunn Creek (aka Hatters Branch) to stay below the new NWP14 0.05 acre stream loss threshold. The
subdivision plans were further designed and reviewed by the Town. The Town required to greenway trail connections to both the east and west. S&EC
worked with the applicant to revise their plans such to avoid new pedestrian bridge crossing of Dunn Creek and instead connect to the existing greenway
closer to Hwy 98 Bypass. S&EC also identified the remain of an old mill site and another consultant's wetland delineation flags in the floodplain areas
along Spring Branch near Hwy 98 bypass, and worked with the applicant and their engineers to relocate the western greenway trail connection further
south to avoid the mill site and potential wetlands.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
The project will obtain an erosion control plan from the Town of Wake Forest prior to construction. The project will also obtain a post -construction
stormwater management plan from the town. These plans and oversight by the town will help avoid and minimize impacts both during and after
construction.

The only buffer impacts that require mitigation for the project are those associated with the Friendship Chapel Road extension across Dunn Creek.
Buffer impacts were approved for this crossing previously in 2020, but never occurred. However, the buffer mitigation was paid (see attached invoice
documentation) in March 2022 for 63,941 credits. As such, these previously purchased credits will more than cover the buffer mitigation required under
the new minimized plans. The overage is 10,071 credits. The applicant will work with the mitigation banker on any potential refund & ledger change after
the anticipated approval of this new request.

SHPO HPOWEB - The project was previously permitted. SHPO HPOWEB shows nothing within or near the project area. The remains of an old mill were
found (photo attached) along Spring Branch near the NCDOT right of way and culverts for Hwy 98 bypass. No impacts are proposed to this mill site and
the greenway trail connection was relocated to the south to avoid it.
