Dear Mr. Cottom:
On March 215t, 2023, the Division issued a Notice of Violation (NOV) against Hawksnest Utilities —
Valley Creek WWTP. The NOV was based upon violations concerning limit exceedance of Nitrogen,
Ammonia Total and frequency violations concerning Temperature. Upon further investigation it was
discovered the parameters set in the Basinwide Information Management System (BIMS) were the
effluent limitations involving the expansion to 0.09 MGD. The facility has not expanded to 0.09 MGD
and is still operating at 0.01 MGD.
Based on this information, I have withdrawn the NOV against Hawksnest Utilities — Valley Creek WWTP
for the cited violations and directed that the record of these violations be removed from our files. As of
the date of this letter, BIMS parameters have been corrected to reflect effluent limits of 0.01 MGD.
