I assume that any new withdrawals would require registering with CCPCUA, assuming there are no thresholds
involved. I assume Duke knows this, but it's good to remind them.
Concerning the 20%, there's nothing that would prevent them from exceeding the threshold if Duke did a field
study first to establish terms and conditions. You might remind them that they stated that they would not use
the two pumps simultaneously and that exceeding the 20% threshold may require a field study to determine
potential impacts.
Do you think dredging the two canals is reasonable for temporary intakes? I guess they do create additional
aquatic habitat.

Do you think I could just condition the 401 approval to limit the use of the drought intake and that the total cannot
exceed the 20% threshold and they must include the drought intake and dust control intakes in future CCPCUA reports?

I didn't think to think that the Lee Station was in the Central Coastal Plain Capacity Use Area (CCPCUA) region.
They have met their reporting requirement because they register their withdrawals under that statute.
Based on the sheet that you attached, with a maximum withdrawal capacity of 17.928 mgd (27.7 cfs), and an
old 1998 USGS Neuse report with a 7Q10 listed for the USGS gage mentioned in the application (02089000) of
207 cfs, the current pumping capacity is less that the 20%7Q10 threshold of 41 cfs. However, the proposed
drought intake (10.8 mgd = 16.7 cfs) would have a cumulative withdrawal capacity of 44.4 cfs with the existing
intake, which would exceed the 20% threshold. The two proposed dust control intakes of <1 mgd would add
into this exceedance if all intakes were operating at maximum capacity simultaneously. (The gage is
downstream, so ratioing the flow record upstream to the site may produce a slightly lower flow value. And,
this does not factor in other withdrawals in the impacted reach. Also, a more current 7Q10 at the gage, or a
7Q10 at the intake site, would be preferable.)
The application states that the five proposed drought pumps in the Finger Canal would not be used in
combination with the existing intake.

about or referring to really so hoping maybe you could give me your thoughts on whether this report that they submit
indicates that maybe they are following protocol but maybe not on the registration list because it’s been in place for so

I have attached a copy of HF Lee’s annual water withdrawal report for 2022. I am still looking for drawings within
historical CP&L files. It is my understanding that the intake structure was constructed at the same time CP&L completed
construction of Unit #3 for the coal steam station and it was constructed in the location of former discharge
structure. The timeframe would have been in the 1960s. I have attached a drawing from 1960 that shows the location
of the former discharge structure.

It was good to see you yesterday. I was reviewing the modification request for HF Lee and have some questions about
the intake that I thought maybe previous permitting would answer but I can’t find any file associated with this project
that talks about the Intake.
We don't see Duke's Lee Plant withdrawal registered on DWR's registration website:

was the intake officially permitted at some point in time? If we can document that it would help. Since it
wasn’t on the registration that made me concerned that it’s old enough that maybe it was never authorized
via a 404/401 and/or registered as a withdrawal.
