(S&ME) is conducting an environmental review of the proposed road, water, and sewer infrastructure construction project on newly acquired property located along Moncure Pittsboro Drive in Moncure, Chatham County, North Carolina. The information contained herein was prepared as part of an evaluation of potential impacts to migratory birds, threatened, endangered, and proposed species, and critical habitat. SITE DESCRIPTION The Deep River State Trail Public Access Area is a NC State Parks & Recreation project to provide greater public access to Deep River for recreation. This project is primarily intended to serve as a kayak put-out area for paddlers who had put-in further upriver. The route of the access road was planned strategically to minimize impacts to buffers and existing wetlands. The 20’ wide proposed access road from Moncure-Pittsboro Highway to the proposed parking lot and restroom facility utilizes the existing road as feasible. From the parking lot to the kayak drop-off area, the road is proposed 12’ wide to limit impacts to the existing wetlands and other heavily wooded areas. From the drop-off area to the launch, there is a 6’ wide natural surface path widening to a 12’ concrete kayak launch within the Chatham County’s 100’ buffer. Stormwater and erosion control permits for the project will be submitted through NCDEQ. Within the Deep River State Trail Public Access Area, the land is subject to a NC Land and Water Fund Conservation Agreement. Per the NC Natural Heritage Program managed areas dataset, the land subject to the conservation agreement is managed for multiple uses which may include extractive or off- highway vehicle use. In addition, portions of the property are part of the Deep River State Trail Dedicated Nature Preserve. This area is managed for biodiversity where disturbance events are permitted to proceed or are mimicked. With the exception of a small area, the limit of disturbance for this project will utilize the previously disturbed footprint of an existing gravel road. Therefore, additional impacts to the Nature Preserve will be minimal in nature. The USFWS website indicates that no designated critical habitat has been reported as occurring within the project area. As listed in Table 1 below, several federally-protected species are listed within the vicinity of the Site in Moncure, North Carolina. During the fall, these bats surround the woodlands where they hibernate and during the summer months, the northern long-eared bat roosts underneath bark or in the cavities and crevices of dead or live trees. They can also roost in caves or mines. The project is not located within ¼-mile of a known hibernation site or within a 150-foot radius of a known, occupied maternity roost during the pup season (June 1 – July 31), and the site is located entirely outside of counties identified by the Raleigh Field Office as containing confirmed hibernation and maternity roost sites. Therefore, the project is considered exempt from incidental take under the final Section 4(d) of the Endangered Species Act \[4(d) rule\] for this species (effective February 16, 2016). Because the site contains suitable habitat in the form of mature trees, the northern long-eared bat has a ‘may affect, likely to adversely affect’ determination; therefore, incidental take, though unlikely to occur, is permissible. The northern long-eared bat was not identified as a species with the potential to occur in this location by the Information for Planning and Consultation (IPaC) report. January 16, 2023 2 Protected Species Consultation Proposed Deep River Kayak Launch Moncure, Chatham County, North Carolina S&ME Project No. 22050051 Bald Eagle Status: Bald and Golden Eagle Protection Act Biological Determination: No effect The bald eagle prefers to nest in large mature trees within half a mile of coastlines, rivers, or large lakes which provide adequate feeding grounds. The proposed kayak launch will be located adjacent to and within the Deep River, a body of water large enough to support the bald eagle. No nests were identified during the jurisdictional stream and wetland delineation and no bald eagles were identified during a search of the NCNHP automated database. Therefore, the project will have no effect on the bald eagle. Tricolored Bat Status: Federally-Proposed Endangered Biological Determination: May affect The tricolored bat has an average body length of 3 to 3.5 inches, with a wingspan of 9 inches. The tricolored bat is distinguished by its unique tricolored fur that appears dark at the base, lighter in the middle, and dark at the tip. Tricolored bats often appear yellowish, varying from pale yellow to nearly orange, but may also appear silvery- gray, chocolate brown, or black. Newly flying young are much darker and grayer than adults. During the spring, summer, and fall - collectively referred to as the non-hibernating seasons - tricolored bats primarily roost among live and dead leaf clusters of live or recently dead deciduous hardwood trees. In the southern and northern portions of the range, tricolored bats will also roost in Spanish moss (Tillandsia usneoides) and old man’s beard lichen (Usnea trichodea), respectively. In addition, tricolored bats have been observed roosting during summer among pine needles, eastern red cedar (Juniperus virginiana), within artificial roosts like barns, beneath porch roofs, bridges, concrete bunkers, and rarely within caves. Female tricolored bats form maternity colonies and switch roost trees regularly. Males roost singly. During the winter, tricolored bats hibernate - which means that they reduce their metabolic rates, body temperatures and heart rate - in caves and mines; although, in the southern United States, where caves are sparse, tricolored bats often hibernate in road-associated culverts, as well as sometimes in tree cavities and abandoned water wells. Tricolored bats exhibit high site fidelity with many individuals returning year after year to the same hibernaculum. This project will involve the removal of deciduous hardwood trees which serve as potential habitat for the tricolored bat. No critical habitat has been designated for this species and as a candidate species, the tricolored bat is not currently subject to protection under the Endangered Species Act. In the event that the tricolored bat becomes listed as endangered under the Endangered Species Act before the project is initiated, appropriate measures, such as a formal survey, should be taken if recommended by the USFWS. January 16, 2023 3 Protected Species Consultation Proposed Deep River Kayak Launch Moncure, Chatham County, North Carolina S&ME Project No. 22050051 Red-cockaded woodpecker Status: Federally-Listed Endangered Biological Determination: No effect The red-cockaded woodpecker is a small bird approximately seven inches long. This bird is differentiated by a white cheek patch and their black and white barred back feathers. In addition, males have small red feathers underneath the black top of the head and the white cheek patch. The red-cockaded woodpecker requires open stands of mature pine. The mature pine generally needs to be approximately 60 years old or older. There are no mature, open pine stands within the project site. Therefore, the project will have no effect on this species. Cape Fear Shiner Status: Federally-Listed Endangered Biological Determination: May effect The Cape Fear shiner is a small fish approximately two inches in length. It is a yellowish colored minnow with a black band along the sides with fins that are yellow and somewhat pointed. The upper lip is black, and the lower lip has a thin black bar along its margin. They are generally found in waterbodies with gravel, cobble, and boulder substrates and are known to inhabit slow pools, riffles, and runs. During spawning season, adults move to slower flowing pools to lay eggs within the rocky substrate. Juveniles are found within slack water such as large rock outcrops in the midstream or flooded side channels. These fish are endemic to the upper Cape Fear River basin and are currently known to be in the mainstem and some tributaries of the Deep, Rocky, Haw, and Cape Fear Rivers. They are most often found in main river channels, sometimes migrating to smaller tributary streams during winter months. A search of the NCNHP database identified a known population of the Cape Fear shiner in the Deep River directly south of the site. The proposed kayak launch will be cut into the bank of the unnamed tributary of the Deep River. The launch will consist of concrete with a stone base beneath. Once the kayak launch is cut into the stream bank, the water level will extend further than it does currently. A coffer dam or similar device will be used to allow construction to take place in the dry. Due to the proximity of the site to the main stem of the Deep River and potentially suitable gravel and gobble substrate of the tributary, this project has the potential to affect the Cape Fear Shiner by displacing the species from the section of stream being impacted during construction. Measures such as an approved sediment and erosion control plan will be implemented to reduce sedimentation and the potential for additional impacts to the species post construction. Monarch Butterfly Status: Candidate Species Biological Determination: No consultation necessary The Monarch butterfly is under consideration for official listing for which there is sufficient information to support listing (candidate listing). There are generally no section 7 requirements for candidate species. Adult monarch January 16, 2023 4 Protected Species Consultation Proposed Deep River Kayak Launch Moncure, Chatham County, North Carolina S&ME Project No. 22050051 butterflies are large and conspicuous, with bright orange wings surrounded by a black border and covered with black veins. The black border has a double row of white spots, present on the upper side of the wings. Adult monarchs are sexually dimorphic, with males having narrower wing venation and scent patches. The bright coloring of a monarch serves as a warning to predators that eating them can be toxic. During the breeding season, monarchs lay their eggs on their obligate milkweed host plant (primarily Asclepias spp.) and the larvae feed on milkweed. Milkweed species are commonly found in open areas such as meadows, old fields, woodland edges, roadsides, utility lines, and other open areas. The site does not appear to contain habitat suitable for the monarch butterfly. No critical habitat has been designated for this species and as a candidate species, the monarch butterfly is not currently subject to protection under the Endangered Species Act. In the event that the monarch butterfly becomes listed as endangered or threatened under the Endangered Species Act before the project is initiated, a survey should be conducted if recommended by the USFWS. Harperella Status: Federally-Listed Endangered Biological Determination: May affect Harperella, a perennial herb grows to a height of six to 36 inches, The leaves are hollow, quill-like structures. The small, white flowers are arranged in heads and five. Seeds are elliptical, compressed, and 0.06-0.08 inches in length. Riverine populations flower in late June or July and continue to bloom until frost. In pond habitats, these species begin flowering earlier, in May. Harperella prefers rocky or gravel shoals and sandbars and along the margins of clear, swift-flowing stream sections. The NCNHP identified a known population of harperella downstream from the proposed kayak launch. Photos of the bank of the Deep River and streams within the proposed project area are included in the attached photo log. No known surveys for harperella have been completed within the proposed project area. While other sections of the stream contain rocky shoals which would provide suitable habitat for harperella, the location of the proposed kayak launch has a stream bank approximately five to six feet in height and drops directly down into the stream. Therefore, due to a lack of suitable habitat in the location of the proposed kayak launch, the project is not likely to affect this plant. However, due to the proximity of the project to potential habitat, a “may effect” determination has been applied. Additional measures such as the implementation of an approved sediment and erosion control plan will reduce the potential for additional impacts to any nearby suitable habitat. CONCLUSIONS Based on the readily available information and a review of habitat conditions, no suitable habitat is present for the bald eagle, red-cockaded woodpecker, or monarch butterfly resulting in a “no effect” determination for these species. Because the site contains suitable habitat for the northern long-eared bat, the project has a “may affect, likely to adversely affect” determination; therefore, under the species’ 4(d) rule, incidental take is permissible. Potential habitat is present for the tricolored bat, which is identified as a proposed endangered species under the ESA. In the event that this species is listed before the project commences, further consultation should be undertaken with the USFWS. Marginal suitable habitat for the Cape Fear Shiner and harperella was identified during the site visit, resulting in a “may effect” determination.
