Dear Mr. Yates,

The Division of Water Resources (DWR) received a draft Bank Parcel Development Package
(BPDP) for the EMH Farm (Site) in 2022, for review and approval under the terms and conditions of
the EMH Farm Mitigation Banking Instrument for Riparian Buffer Mitigation (MBI) received on
October 20, 2022. Effective April 21, 2023, the MBI was made and entered into by Clearwater
Mitigation Solutions, LLC (Eco Terra) acting as the Bank Sponsor, and the DWR. DWR reviewed
the BPDP and MBI documents and provided comments and recommendations. DWR received a
revised BPDP and MBI that addressed all comments and recommendations. The table below
summarizes the timeline of the BPDP and MBI:

The closing date for the public notice was April 14, 2023. DWR received no comments regarding
the subject BPDP and MBI. These documents are now approved and can be found online at the
