Dear Mr. Beinenson,

The Division of Water Resources (DWR) received a draft Bank Parcel Development Package
(BPDP) for the Britt and Hales (Site) in 2022, for review and approval under the terms and
conditions of the Britt & Hales Mitigation Banking Instrument for Nutrient Offset and Riparian
Buffer Mitigation (MBI) received on September 22, 2022. Effective April 21, 2023, the MBI was
made and entered into by Eco Terra, LLC (Eco Terra) acting as the Bank Sponsor, and the DWR.
DWR reviewed the BPDP and MBI documents and provided comments and recommendations.
DWR received a revised BPDP and MBI that addressed all comments and recommendations. The
table below summarizes the timeline of the BPDP and MBI:

The closing date for the public notice was April 14, 2023. DWR received no comments regarding
