Please find attached four copies of the Pre - Construction Notification Application for the above
referenced site The site contains two dilapidated residential structures, wooded land, recently
timbered land and overgrown fields The site is being proposed for development with a single
family residential development
In order to develop the site, a road must be constructed that will cross a pond Additionally, 0 09
acres of wetland are proposed to be impacted with lot fill Mitigation is not proposed
I am requesting that a 401 Water Quality Certification be issued to authorize the proposed
impacts There are no additional wetland or stream impacts proposed at this time Please feel

The purpose of the proposed project is to provide access /utility infrastructure and to facilitate development of the site as a
residential sub- divison

The overall project consists of developing the site with a 91 lot residential sub - division In order to provide safe line -of-
site access to the residential sub - division, an access road from Birch Creek Road is necessary Additionally, utilities will
be provided with the access road right -of -way To facilitate the construction of the access road and development of the
site, clearing and grading the site is necessary Graders, haulers, excavators and other heavy equipment will be used
during grading and construction of the site

61 Comments The site is located within the Cape Fear River Basin in an area that has been designated as WS -IV, NSW In
addition, the site is located within the Lake Jordan Watershed Based on our field observations, there are no intermittent or
perennial streams located immediately up or down - gradient of the pond on the site The pond dam spillway has eroded and
created a drainage feature due to the gradient However, it discharges into a linear wetland located at the base of the dam
An off -site stream originates more than 100 feet south of the pond, down - gradient of the linear wetland, based on GPS
measurements Wetlands are also located up- gradient of the pond Features with discernable beds and banks are not
located up- gradient of the pond According to the Jordan Water Supply Nutrient Strategy Protection of Existing Riparian
Buffers (15A NCAC 02B 0267), (5) Exemption Based on On -site Determination, "When a landowner or other affected party
including the Division believes that the maps have inaccurately depicted surface waters, he or she shall consult the
appropriate local government Upon request, a local government representative who has successfully completed the
Division's Surface Water Identification Training Certification course, its successor, or other equivalent training curriculum
approved by the Division, shall make an on -site determination Local governments may also accept the results of site
assessments made by other parties who have successfully completed such training Any disputes over on -site determinations
shall be referred to the Director in writing A determination of the Director as to the accuracy or application of the maps is
subject to review as provided in Articles 3 and 4 of G S 150B Surface waters that appear on the maps shall not be subject to
this Rule if a site evaluation reveals any of the following cases (a) Man -made ponds and lakes that are not part of a natural
drainage way that is classified in accordance with 15A NCAC 02B 0100, including ponds and lakes created for animal
watering, irrigation, or other agricultural uses A pond or lake is part of a natural drainage way when it is fed by an intermittent
or perennial stream or when it has a direct discharge point to an intermittent or perennial stream" Based on our field
observations, it is our opinion that the pond located on the southern portion of the site should not be subject to the Jordan
Water Supply Nutrient Strategy Protection of Existing Riparian Buffers (15A NCAC 02B 0267)
D Impact Justification and Mitigation
1 Avoidance and Minimization
1a Specifically describe measures taken to avoid or minimize the proposed impacts in designing project
Due to the use of the site for residential development, a road must be constructed to provide access to the site The road has
been designed in a location that allows for safe line -of -sight along Birch Creek Road, while also providing interconnectivity to
an existing residential sub - division located west of the site The location of the road crossing has been designed to cross the
narrowest portion of the pond Additionaly, the location of the proposed sewer line is located beneath the proposed road right
of way, thus avoiding other potential impacts to jurisdictional features located on the site
Lot layout has been designed to maximize the number of lots, while also meeting the City of Greensboro zoning requirements
(minimum 7,000 square feet and appropriate setbacks) Additionally, the lot layout has also been designed to satisfy
developer front setback requirements for pad location The lot layout meets the above requirements and has been designed
in a manner that minimizes the impact to the wetlands /pond located on the site The proposed lots between lots 70 and 71
(view impact drawing WL 1 -2 and WL 1 -3) have been eliminated due to the presence of wetlands Additionally, the lots have
been re- designed multiple times with emphasis on avoiding impacts to wetlands /pond located on the site Proposed impacts
to lots 66, 72 and 73 have been avoided due to reduction of lot site Likewise, lots 68 to 70 have been re- designed with a
different orientation, thus reducing the amount of impact to the head of the wetland

The site contains a 0 45 acre pond and 0 48 acres of wetlands The remaining 0 392 acres of pond and 0 39 acres of wetland
have been avoided

The clearing limits will be staked and silt fence will be used Disturbance limits will be surveyed, staked and marked with high
visibility fencing The pond will be pumped to lower water elevation such that work will be conducted in the dry Following
construction, disturbed slopes will be stabilized with permanent seeding, matting and temporary slope linings Best
management practices will be implemented during construction activities to avoid sediment discharge into downgradient water
bodies
