Sue: I apologize for the delay my surveyor was out of the country for almost two weeks. Attached is an updated survey with the pool and disturbance area outside the projected pool & deck area. The total square footage as originally stated that will be disturbed during construction and for the actual permanent placement is roughly 1500 square feet. As I understand it, Zone I is from the water line inward 30 feet? Is that accurate? If so, we do not plan to use or disturb any space in Zone I. According to the plan we will use a portion of Zone II and the rest will be outside Zone II. The total amount of square footage that would be disturbed wouldn't exceed 2000 square feet. I am getting the pool contractor & surveyor to confirm and update plot diagram to represent these specifics. I will get this back to you ASAP. Best Regards!! The difference may be minor, however it does appear that accurately reflecting the curvature of the buffer would benefit you by a few more feet. The buffer is typically measured with any curvature of the edge of the pond or stream. 3 Depending on your answer to the note above, the drawing still shows that some of your pool/patio will be in Zone 1. I will need this area accurately calculated in order to consider authorizing any activity in Zone 1. As I stated previously, I also need you to provide specific plans that show all areas that will be disturbed temporarily as part of the construction of the pool. This would be beyond the footprint of where the pool will be when all is said and done. Given the size of your lot and location of your house, I would assume equipment and disturbance would occur further into the buffer in order to construct the pool. We need to know exactly how much and exactly where the disturbance would be. Shown on plans and calculated in square feet. Lastly, IF we are able to authorize the pool, the Tar Pamlico Buffer rules require that the impacts to the buffer are to be mitigated. Mitigation must be done in accordance with state regulations and laws. That would require calculation of the final amount of buffer impact (based on above notes) multiplied by “zonal multipliers” (multiple the square footage impact in Zone 1 by 3 and in Zone 2 by 1.5) and payment into a private mitigation bank (if there is one available) or a state fee system (if there are no private banks available). First we need to be sure we have all your final numbers correct, then I can assist you to determine the final amount of payment and who to contact about that. As an estimate, the state system current rate is $1.29 per square foot but it may cost more if you are required to pay into a private bank. We had the original lines (Blue) and then they drained the pond when a hurricane was going to hit and the second set (yellow) is the original stream lines before the pond was created by Golf Course. I am attaching the original survey without the second set and I have highlighted the water line, Zone I, & Zone II. I have also attached an aerial picture of our home/property with an outline of the where the pool would be installed. Please let me know if this helps. The buffer regulations indicate that the Zone 1 starts at the water line of the adjacent open water/pond and is 30 feet wide, 4 then Zone 2 is another 20 feet from that point. The total buffer should be 50 feet and should follow along the edge of the pond, rather than be a straight line as the blue lines on the attachment are drawn. If the blue lines are correct, it shows your pool within Zone 1 of the buffer but your application states the pool would only be in Zone 2. For clarification, I need a drawing that shows the exact limits of ground disturbance for installation of the pool (even if only temporary) and where the exact edge of the pool deck/concrete pad will be when complete, all in relation to the accurate buffer Zone 1 and Zone 2 lines are. It appears that your project will require an “Authorization Certificate with Exception” (formerly called a variance). The process is defined in 15A NCAC 02B .0611(c). Item (1) under that rule includes a list of conditions that all must be met in order to quality for the exception. Please be aware that the Division is required to evaluate all projects in accordance with this regulation. Again, please keep in mind the survey is not accurate to where the pool will be placed. Due to the size, shape, and curvatures roughly less then half of the pool would be in Zone II. Good morning Julie, I hope your holiday season is off to a great start. I wanted to connect regarding a variance buffer request in Greenville, NC. We want to install a pool on our property that backs up to a "Man-Made" pond on the Brook Valley golf course. The pool is 16' x 40' which would require roughly 10-15' variance into zone II. I am attaching the original survey document prepared by the contractor that was submitted to the City of Greenville for approval. This drawing is not exactly accurate to where the pool will be. It shows the entire pool in Zone II, but we only need a small portion of Zone II due to the size and curvature of the pool. I read through the NCDENR 401 buffer permitting documents and there is no reference to pools either For or Against? We in no way plan to harm or change anything within Zone I and will also provide any type mediation recommended for a successful outcome. I would like to speak live after you review the information and request provided so we can discuss the specifics.
