HomeMy WebLinkAbout20080915 Ver 2_CRA Parties Outreach Meeting April 13 - 17 2015_20150507CATAWBA- WATEREE COMPREHENSIVE RELICENSING AGREEMENT Signatory Parties Outreach Meetings April 13, 157 16, and 17, 2015 Our Purpose Reinvigorate communications among Parties for the successful implementation of the New License and the Comprehensive Relicensing Agreement (CRA) for the Catawba- Wateree Hydroelectric Project. Objectives of Outreach Meetings Review the Federal Energy Regulatory Commission (FERC) relicensing process and where Catawba- Wateree is in the process. 2. Review how the CRA was developed and its benefits to all Parties. 3. Prepare Parties to participate: a) between now and the issuance of the New License b) after the New License is issued (dealing with possible inconsistencies with the CRA) c) after the New License is "final" Introduce the Final Agreement Committee (FAC) and explain its role. Discuss next steps and communications needs. FERC's Reficensing Process The National Environmental Policy Act (NEPA) process requires FERC to evaluate and recommend a "preferred alternative" for a New License. The CRA is our recommended preferred alternative to FERC. Local priorities and local solutions that are balanced and sustainable Includes features that will be in the License (e.g., flows, lake levels) Includes features that will be enforced by contract (the CRA) (e,g., land conservation) FERC favors settlements and has a "Settlement" policy, which we followed. With only minor modifications, FERC staff recommended our CRA as the preferred alternative in its July 2009 Environmental Impact Statement. CRA Section 16.1: ... effective for all Parties on December 22, 2006. ... shall remain in effect for the term of the New License for the Project and for any annual licenses issued subsequent thereto... CRA Section 19.1 ... all Parties that are governmental entities, including Tribes, believe that this Agreement is consistent with their statutory responsibilities. CRAS Enforceable as a Contract Resource Full extent of New License requirements and Agreements consistency with the CRA (Sections 1 -15) will not be known until the New License is issued. General Agreements and CRA 39.3 - Enforceability — Procedures As noted in Paragraph (Sections 16 -39) 31.1.3, all terms of this Agreement not incorporated as License Articles shall be Signature s enforced through remedies available under applicable state or federal law. (i) within 10 calendar days following the issuance of any draft or final 401 Water Quality Certification, environmental assessment or environmental impact statement; (ii) within 10 calendar days following receipt of any notice from any Party identifying an alleged Inconsistent Act by a Jurisdictional Body or the proposed withdrawal of any Party from this Agreement; (iii) within 30 calendar days following receipt of any notice from any Party identifying an alleged or potential breach of this Agreement by any Party or the need to implement dispute resolution; and (iv) any time as deemed necessary by a majority of its members, but at least annually beginning in 2007 and continuing through the term of the New License (including any annual license renewal periods).
