HomeMy WebLinkAbout20201654 Ver 2_USACE Permit_20220412DEPARTMENT OF THE ARMY WILMINGTON DISTRICT, CORPS OF ENGINEERS ASHEVILLE REGULATORY FIELD OFFICE 151 PATTON AVENUE, ROOM 208 ASHEVILLE, NORTH CAROLINA 28801-5006 April 12, 2023 Regulatory Division Action ID: SAW-2020-00632 Mr. Richard Kelly Mulberry Farm — Madison LLC 1126 Upper Thomas Branch Road Marshall, NC 28753 Dear Mr. Kelly: Enclosed is a Department of the Army permit to construct the School of Wholeness and Enlightenment (SOWE) which will include cabins, school buildings, horticultural building, event center, dining hall, gym, wholeness center, staff houses, and administrative building. The road network supporting the school and campus includes culvert crossings that impact streams and wetlands. Several existing culverts will be removed, and the affected stream reach restored. A Beaver Dam Analog (BDA) structure will be constructed to create an aesthetic pond at the entrance and potentially enhance aquatic habitat on site. Total impacts are 904 LF of stream channel (0.085 acre) and 0.053 acre of wetlands. The Corps is issuing this permit in response to your written request of January 27 2022, and the ensuing administrative record. The Corps is in receipt of the revised plans submitted March 24, 2023, describing the change to the construction sequence for the Bac-of-hose/Administrative Building. This modification involves the temporary installation of a 60 liner foot culvert for construction access. Stream enhancement activities within this stream reach will proceed following culvert removal as previously proposed. Accordingly, permit condition a. Work Limits has been revised to reflect the updated plans. Any further deviation in the authorized work will likely require modification of this permit. If a change in the authorized work is necessary, you should promptly submit revised plans to the Corps showing the proposed changes. You may not undertake the proposed changes until the Corps notifies you that your permit has been modified. Carefully read your permit. The general and special conditions are important. Your failure to comply with these conditions could result in a violation of Federal law. Certain significant conditions require that: a. You must complete construction before December 21, 2028. b. You must notify this office in advance as to when you intend to commence and complete work. c. You must allow representatives from this office to make periodic visits to your worksite -2- as deemed necessary to assure compliance with permit plans and conditions. d. In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined in the U.S. Army Corps of Engineers, Wilmington District, Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit authorization.
