Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The existing conditions on site are agricultural and wooded, with a large pond. Phase 1 (south of Pippin Road) which was previously permitted. has been constructed. The southern portions of Phase 2 (north of Pippin ,Road) have been graded and infrastructure has been completed. The general laird use in the vicinity of the project is primarily wooded, some agricultural and residential. 3b. Explain the purpose of the proposed project: The purpose of the proposed project is complete a residential development that was previously designed and approved by local, state and federal permitting agencies. The purpose of the proposed impacts is to access the northwestern and the eastern portions of the property, in addition to providing utilities. 3e. Describe the overall project in detail, including the type of equipment to be used: The overall project consists of constructing a road crossing to access the north side of the property on the western side of the stream & pond system, to construct a road crossing to access the northwestern "pod" of the property, and to construct a road crossing and utility crossing at the pond dam to access the eastern side of the property. Development on the property will include roads, utilities, residential lots and diffuse flow facilities. Equipment such as bull dozers, bucket loaders, excavators and other typical equipment used for land disturbance and construction will be utilized for this project. 4. In 2005 an application was submitted to both the USA CE and the DWQ for impacts to streams, wetlands and riparian buffers for impacts associated with the residential development Weavers Pond. A Nationwide Permit 12 & 39 was issued on March 13, 2006, AID # 200520460 and 200620187 (see attached). A 401 Water Quality Certification and Neuse Buffer Authorization Certificate Approvals were issued on March 20, 2006, DWG? Project #2005 -2070 (see attached). The 404 Nationwide Permit Verification required compensatory mitigation for 0.46 acres of riparian wetland impact, 0.5 acres of riparian wetland mitigation was paid to the NCEEP on June 21. 2006 (see attached receipt). It is important to point out that this request is a continuation of the construction plans originally approved in 2006 by Zebulon and Wake County, both entities have determined this project to be grandfathered. The project sat dormant for several years and the property was foreclosed on, the new owner is now proceeding with the Phase 2 construction already approved by Zebulon and Wake County. 6. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. SBEC completed a wetland delineation and Neuse River Buffer evaluation for the entire property in order to identify natural resources so that the project engineer could design a site plan that would minimize impacts to the maximum extent practicable. The proposed project includes three remaining impact areas to the Weavers Pond Subdivision. Please note that the impacts numbers are successive to the previously authorized project. The proposed Wettand Impact #2 is a new impact area however was shown as a future impact on the previous authorized site plans. This crossing is necessary to access the northwestern portion of the project. The Town of Zebulon and the 2000 Edition of the International Fire Code requires 2 points of access for the proposed number of residential lots, I have attached both a memorandum from the Town of Zebulon and the 2000 Edition of the International Fire Code for reference. This proposed impact includes permanent and temporary wetland impacts for a road crossing. The proposed Crossing #3 Impact Area was previously authorized as first a standard culvert and then later an Arch Span. Further investigations determined the lack of bedrock to support the Arch Span; therefore the applicant is again proposing a standard culvert road crossing. This proposed impact includes permanent and temporary stream impacts, along with temporary wetland impacts and riparian buffer impacts for a road crossing. Headwalls have been proposed to minimize total impacts. The proposed Crossing #4 impact Area is a new impact area however was shown as a future impact on the previous authorized site plans. This road crossing and water line is necessary to access the eastern portion of the project and provide utilities. Similar to Impact #2, a second point of access is required by Zebulon and the Fire Code for emergency access. This proposed impact include permanent and temporary stream impacts and open water impacts associated with the road crossing and water main. Additionally, the applicant is proposing dam maintenance to improve the integrity of the dam structure. The applicant would like to utilize NWP 3 for impacts associated with the dam maintenance, specifically the new outfall and riparian buffer impacts.. Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 29 & 3. With respect to residential development conditions (NWP 29- Regional Conditions section 4.0) there are no impact associated with single - family recreation facilities, there are no permanent wetland or stream fills proposed within the floodwayJfloodplain and the stream classification for this project is C, NSW (i.e. not Outstanding Resource Waters, Nigh Quality Waters, Coastal Wetlands or wetland adjacent to these waters). 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Construction techniques will consist of installation of coffer dams upstream of the impacts with clean water by -pass piping provided. The impacted areas will be wrapped with temporary silt fence with a reinforced outlet during the installation of the culvert crossings and placement of the roadway embankment fill. Construction will also be requested to on!y take 21ace during Yry periods to minimize downstream im acts.. 2. Proposed Stream Riparian Buffer Planting Plan In a correspondence to the DWQ, dated March 3, 2006, MacGregor Development Company proposes to restore/enhance the riparian buffer along the stream channel associated with Road Crossing No. 3, on the site plan. The planting plan proposes at least two native hardwood tree species be planted at a density sufficient to provide 320 trees per acre at maturity. This density can be achieved by planting approximately 436 (10x10 feet spacing) to 681 (8x8 feet spacing) bare root seedlings per acre. After reviewing the restoration/enhancement plan submitted by MacGregor Development Company, the DWQ has determined it would be covered under GC3374. 7. Deed. Notifications Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. Diffuse F~ ow (DWQ Reviewed Plans) All stormwater shall be directed as diffuse flow at non - erosive velocities through the protected stream buffers and will not re- concentrate before discharging into the stream as identified within. 15A NCAC 2B .0233(5) In an effort to comply with the diffuse flow provision of the Buffer Rule (15A NCAC 02B .0233(5)), you have provided the DWQ with level spreader designs dated February 13, 2006, The DWQ believes that if implemented, as per these plans, diffuse flow will be achieved. However, if diffuse flow as per 15A NCAC 02B .0233(5) is not achieved, then the DWQ shall be notified and corrective actions to restore diffuse flow shall be taken if necessary to impede the formation of erosion gullies. At no time shall stormwater from the proposed development be piped directly through the buffer without prior DWQ written authorization. The structural stormwater practices as approved by this Office as well as drainage pattcrns must be maintained in perpetuity_ No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. Stormwater easements shall be recorded for a distance of at least 10 feet on each side of all stormwater conveyances and on all lots containing these structures including future access for maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide ,protection of the structures from potential alternations by future property owners. An Operation & Maintenance (O &M) agreement signed by the current landowner must be approved by the DWQ. This O &M agreement must transfer with the sale of the land or transfer of responsibility for the stormwater facilities and the DWQ must be notified of every transfer. Construction Storinwater Permit NCG010000 Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an NPDFS General stormwater permit (NCGb 10000) administered by DWQ is automatically issued to the project. This General Permit allows stormwater to be discharged during land disturbing construction activities as stipulated by conditions in the permit. Looped Lane To assist developers and designers in meeting our requirements, we have defined some terms and listed minimum design standards considered necessary for effective fine fighting operations. u Fire Department Access An approved route that is always available for use by fire trucks and is designed to meet fire equipment load requirements. Except for Loop Lanes, Shared Driveways, and Private Driveways, all access routes must be at least 20' wide. It is our responsibility to ensure adequate access for Fire Department emergency responders. Type of Surface All access roadways shall be finished by application of an all- weather driving surface of hot mix asphaltic concrete or concrete pavement over a flexible base capable of supporting a design wheel load of 18,000 pounds (GVW 80,000 pounds minimum; H -20 loading). The roadway design must be prepared and certified by an engineer registered by the State of Colorado. Any required Fire Department access within 100 feet of any building must meet the same wheel - loading criteria. All required access roadways must be properly maintained and kept clear for emergency use at all times. Any alternatives to these specifications must be reviewed and approved by the Grand Junction Fire Department prior to construction. Aerial Apparatus Roadway Width u 'Fire apparatus access roadways shall have a minimum unobstructed w dth of 26 feet in the immediate vicinity of any building of portion of building more than 30 feet in height. At least one of the required access routes meeting this condition shall be located within a minimum of 15 feet and a maximum of 30 feet from the building, and shall be positioned parallel to one entire side of the building. Maintenance of Access Roads Maintenance of the required access shall be considered during the planning stages and installation of Fire Department access roadways, fire hydrants, or connections.
