Dear Mr. Carrington:
Thank you for your March 14, 2023, correspondence to Michael S. Regan, Administrator, U.S.
Environmental Protection Agency regarding the proposed development of a mixed -use subdivision in
the Town of Matthews, North Carolina. Your inquiry was forwarded to the EPA's Region 4 office in
Atlanta, Georgia, for response.
In your email, you expressed concern that the proposed development will have detrimental effects on
the environment, particularly the Yadkin River and its surrounding tributaries. Additionally, you feel
that there would be a substantial loss of forested lands and old tree growth due to the clearing and
grading activities in preparation of the proposed development.
You requested EPA's assistance to investigate the Town of Matthews' approval of the plan, and the
local Unified Matthews Storm Water Ordinance and regulations that could be circumvented in order to
facilitate development of this project.
EPA Region 4 reached out to local and state officials to investigate your concerns. We understand
Mr. Isaiah Reed, Stormwater Program Coordinator at the North Carolina Division of Energy, Mineral
and Land Resources (DEMLR), has since contacted you. Mr. Reed also contacted Mr. Rusty Rozzelle,
Chief of Surface Water Quality, Mecklenburg County Storm Water Services, regarding the proposed
site. According to Mr. Rozzelle, his department is aware of the challenges associated with the site. He
acknowledged that, while the rezoning has been approved, post -construction and erosion and sediment
control permits have not been reviewed or issued. You can reach Mr. Rozzelle at
