Dear Mr. Benjamin:
Reference the application of the Town of Kill Devil Hills for Department of the Army
authorization to excavate 947,500 cubic yards of beach - quality sediment from two offshore
borrow sources, and deposit the material along approximately 2.75 -mile section of ocean
shoreline, in the Town of Kill Devil Hills, Dare County, North Carolina.
I have reviewed this application and conclude that the proposed work may affect the West
Indian Manatee (Trichechus manatus), Piping Plover (Charadrius melodus), Red Knot (Calidris
canutus rufa), Roseate Tern (Sterna dougallii), Seabeach Amaranth (Amaranthus pumilus), and
the Kemp's Ridley (Lepidochelys kempi), Hawksbill (Eretmochelys imbricata), Leatherback
(Dermochelys coriacea), Loggerhead (Caretta caretta), and Green (Chelonia mydas) sea turtles;
and therefore, I am hereby requesting initiation of formal consultation pursuant to Section 7 of
the Endangered Species Act of 1973, as amended.
