I issued the permit for 50 feet of permanent impacts. The rip rap will be discharged below the Ordinary High Water
Mark, correct? It will not be taken out. The Corps considers it a permanent impact, but does not consider it a loss of
water. The stream length will be the same upon completion of the project.
If this is not correct, please let me know. Thanks.

You do need to issue a permit if the impacts exceed 40' but only if they are permanent impacts. These are all
temporary.

OK, thanks. I believe we need to issue a 401 for impacts over 40' even within the LIBP. I'm not finding in our data files
that you (Heath) submitted an application to NCDWR. Please check when you get the chance.

I had that the impacts were 50' for abutment replacement/bank stabilization.
