This letter respectfully requests the modification of Lonesome Valley's Section 4D~~ permit issued July ~ _,1 16, 2007 (attached). Specifically, this is a modification of the mitigation plan. Pleasemote that as a result of these modifications, the overall stream impacts associated with this project are the same. Lonesome Valley Development, LLC received authorization to (1) permanently impact 592 linear feet of streams for road construction (Phases I and II), (2) temporarily impact 330 linear feet of streams for culvert replacement and 75 linear feet of streams for bank stabilization (both in Phase I), (3) permanently impact 0.047 acre of wetland for pond construction (Phase I), and road construction (Phase II), and conduct 570 linear feet of stream restoration (to be used as part of the mitigation plan for the project). This request for modification applies to the 570 linear feet of stream originally proposed for stream restoration as part of the mitigation plan. The fmal design, completed by Baker Engineering, identified only 440 feet. Therefore, Lonesome Valley Development proposes to participate with the EEP for the remaining balance of mitigation (130 stream feet). The acceptance letter from EEP for the 130 feet is included with this letter along with the design plans for the stream restoration. Please note that this decision does not assure that the payment wi[1 be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be approved. Once NCEEP receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net. If the regulatory agencies require mitigation credits greater than indicated above, and the applicant wants NCEEP to be responsible for the additional mitigation, the applicant will need to submit a mitigation request to NCEEP for approval prior to permit issuance. The mitigation will be performed in accordance with the Memorandum of Understanding between the N. C. Department of Environment and Natural Resources and the U. S. ConsWction access and a staging area mill be established in the vicutity of the upper end of the project Equipment and materials veil/ be mobilized to these locations. 2. Cons W coon will proceed upstream to downstream. Temporary sand bag coffer dams will be installed upstream of each +vork area and flow u+ the work reach +vill be diverted with a pump and piping. The length of each diversion will be approximately 3(10 to SOU linear feet. 3. Temporary stream crossings will be installed at locations shown on the plans. 4. Reach 2 construction involves both enhancement to the existing channel and creation of new off-line channel. Flow diversions will be staged according to lengths of sub- reaches and site constraints. 5. Reach 3 construction will be stet filar [o [hat proposed for reach I. 6. Clearing and grubbing within the gradhtg limits will be performed so az to limit sednnent migration off-site. Logs and root wads from trees larger than 10 inches in diameter will be stockpiled for use in in-stream structures. 7. In areaz where navy channel will be constructed salvageable native vegetation (doghobble; rhododendron; yellowTOOt, etc.), mats will be han ested for transplanting. These mats will be excavated and moved to the banks of the new channel sections. 8. The new channel sections will be stabilized with in-stream swctures; erosion control matting and seed before turning +valer into these sections. Compacted soil channel plugs will be installed N areas where the new channel diverges from the original channel and the original; abandoned chamtel sections will be backfilled. 9. Dewatering of off-line channel sections is expected to be minor. Any +valer pumped during dewatering operations in the off-lice sections ++ill be directed through a sedimem fdter before being discharged into the downstream reach. 1 U. Earthwork will be staged such that no more channel will be disturbed than can be stabilized by the end of the work day or before flow is diverted into a new channel segment. 1 I. Excess soil materials +vill be stockpiled outside the lloodplain ut the staging areas. +vith silt fence instalh;d on the stream side(s) of the base of the stockpiles and maintained when sediment has accumulated above mte third of the height of the silt fence and/or the silt fence has failed. This excess material will be hauled outside the conservation easement or used to backfill abandoned channel before demobilization. 12. The flow diversions and stream crossings will be removed when no longer needed and the banks in these areas stabilized with seeding and matting. 13. Bank and floodplain vegetation, including brush materials and lire stakes, will be installed during dormant season. November to April. 14. Constructan entrances; staging areas and silt fences will be removed once plantutg is complete or once they are no bnger needed.
