Dear Mr. Allen,
In response to your Notices of Violation (NOV 2023-PC-0052, 0053 and 0079) of February 28, 2023 for
Warren Swine Farms E Warren #3 (82-405), Swain Farm (82214) and Kennedy 1 Farm (82-19) 1 submit
the following:
Violation 1: Failure to maintain waste levels in lagoons in accordance with Permit # 100000
Section V-2
We had a lot of rain in January and early February which caused our lagoons to go into the "red". We
were pumping as field conditions allowed this winter but the high rainfall amounts and weft field conditions
hindered our ability to irrigate. We notified your office within 24 hours of our first knowledge of the
occurrence. We filed a POA, as required, and now have these lagoons on these farms in compliance.
In response to your Notices of Violation (NOV-2023-PC-0074 and 0075) for the King Farm (82-13) and
Foster Farm (82-71) 1 submit the following:
Violation 1: Failure to maintain waste levels in lagoons in accordance with Permit # 100000

Violation 2: Failure to file a written report within 5 calendar days following first knowledge of the
occurrence facilities: Permit Condition 111.17.
We are testing out a new phone application for recordkeeping with our consultant's company, Barwick Ag
Services, LLC. We began testing this product in October 2022 and there have been some kinks and
glitches to work out and this delayed his ability to provide the reports for these farms. There is a shared
blame for these incidences but 1 realize I am ultimately responsible. The app seems to be working better
at this time. Hopefully this will not occur again in the future.
1 am sorry that these incidents took place. At Warren Swine Farms we are proud of our operations and we
frequently host visitors. Being good neighbors and being good stewards of our environment is very
important to us. I hope that our actions dealing with these issues will be considered when determining the
