I. State and Federal Pemits Required
Written authorization from the USACE and the NC-DWQ is required prior to construction in
wetlands and streams. The USACE is responsible for defining and regulating wetlands and
Waters of the US. Permits to discharge fill material or excavate within wetlands are mandated by
a Section 404 Wetland Permit. The permit that will be utilized for the wetland restoration is the
Nationwide 27 Permit-Stream and Wetland Restoration Activities. Generally, permits issued by
the USACE are not valid unless the permittee receives a 401 Certification from the DWQ. An
application will also be submitted to the DWQ for approval. No work will commence until after
all required permits have been secured.
J. Agency and Public Reviews
Representative from the USACE have visited and reviewed the proposed project three times;
representatives from the NCDOT have reviewed and provided comments; a representatives from
the North Carolina Wildlife Reserve Commission has visited the site and provided comments;
and the Chairman of the Yadkin County Commissioners has written a letter
in support of the project. The comments provided by those indicated above have been
incorporated in the plan and design of the project.
K. Findings of No Significant Impacts (FONSI)
Based on the environmental analysis of the proposed action and the documentation of such
analysis as contained in this Environmental Assessment, it is determined that there is a Findings
of No Significant Impact (FONSI).
