Project Description and History 4a. Site Conditions: The subject property is currently comprised of a of a site that has been managed for timber purposes. There is one cleared area that may have been used as a food plot for wildlife. Jurisdictional waters of the US on site were classified according to USACE and NCDWR guidance. The results of the jurisdictional determination investigation indicated that there were two jurisdictional streams present within the subject property. Stream SA is a perennial unnamed tributary that eventually flows into Waxhaw Creek. Stream SB is a perennial unnamed tributary that eventually flows into Waxhaw Creek. In addition to the two jurisdictional tributaries, there was one jurisdictional wetland located within the project area (Wetland WA). Wetland WA would be considered a headwater forest wetland that was attempted to be drained at some point in the distant past. The ditch was not maintained and has become a portion of the jurisdictional wetland. Wetland WA is dominated by forest vegetation. The bulk of this jurisdictional wetland will not be impacted by the project, only a portion of the old ditch. The project area is within the Catawba River Basin (HUC#03050103)(USGS 1974). Land use in the vicinity of the project consists of rural farm and timber lands with some residential development nearby. 4b. The third phase of the overall residential subdivision will consist of approximately 45 single family residential lots. Wastewater will be treated by means of on-site septic systems as approved by Union County Department of Health. Three stream/wetland crossings are proposed in order to facilitate the proposed development and provide access to Phase 3 of the residential subdivision. (1) a traditional culverted stream crossing that will have approximately 148 Linear Feet (0.027-acre) of permanent stream impact and 20 Linear Feet (0.0037-acre of temporary impacts; (2) a bottomless culvert stream crossing that will have no permanent fill impacts to waters of the US (state); and (3) a culverted wetland crossing that will permanently impact 0.022-acre of jurisdictional wetlands. All three crossings are proposed to facilitate construction of the roadways. To facilitate the development of the site, clearing and grading the site is necessary. Graders, haulers, excavators and other heavy equipment will be used during grading and construction of the site. 4j. Federal and State Threatened and Endangered Species Evaluation The USFWS iPac official species list indicatesspecies with the potential to inhabit the Conservancy at Waxhaw – Phase 3 site. The official iPac Species List identified three species that are considered either FederallyThreatened or Endangered. Those 3 species are Carolina heelsplitter (Lasmigona decorata), Michaux’s sumac (Rhus michauxii), and Schweinitz’s sunflower (Helianthus schweinitzii). Two other species occur on the list Tri-colored bat (Perimyotis subflavus) and Monarch butterfly (Danaus plexippus), but do not require consideration currently as they are listed as “Proposed Endangered” and “Candidate” species, respectively (no consultation required, currently). LEES evaluated the project study area for potential habitat for the three federally listed Threatened (T) or Endangered (E) species that occur on the official species list from the USFWS iPac system. The habitat evaluations/surveys took place in late September-early October 2022. The habitat evaluations/surveys consisted of pedestrian transects across the project site. Within specific areas of potential habitat, for Scheinitz’s sunflower, surveys were completed by walking the rights of way and/or other areas of high interest and reviewing the areas for individual specimens of the target species. Specifically, power/road rights of way, along with areas of early succession/field edges were surveyed for Schweinitz’s sunflower. Carolina heelsplitter (E) is a freshwater mussel that inhabits muddy sand, or muddy gravel substrates along stable, well-shaded stream banks. Habitat is present on site in the form of two small perennial streams with sandy/gravelly substrate. A NCNHT records review indicates that there is occupied/critical habitat below our site in Waxhaw Creek. However, the subject property is separated from the critical habitat by an area managed by Catawba Lands Conservancy that protects the lower reaches of both streams present on site and also a portion of Waxhaw Creek. The smaller of these two creeks was completely dry and the other only had water in a few pools (no flow) during our Schweinitz’s sunflower/Michaux’s sumac surveys during the fall of 2022. In an effort to help protect Carolina heelsplitter, the permittee will be strengthening erosion and sediment controls in areas close to the two small tributaries. Additionally, one LOWRYS ENVIRONMENTAL & ECOLOGICAL SERVICES, LLC April 10, 2023 Page 2 of the streams will be crossed using a bottomless culvert, so there will be no impactto the stream channel at that location. As mentioned above, the NCNHP records indicate that there is occupied/critical habitat within one-mile of the subject property (within Waxhaw Creek) and potential habitat present in the two small streams present on site (even though they were essentially dry during 2022). With this in mind, and with the avoidance and minimization of impacts to the streams, along with stringent sediment and erosion controls for the areas near these two small streams, and the protected buffer present on the lower reaches of the two small streams and Waxhaw Creek, we would propose a Biological Conclusion of May Affect, Not Likely to Adversely Affect for the species. Biological Conclusion: May Affect, Not Likely to Adversely Affect Michaux’s sumac (E), endemic to the inner Coastal Plain and lower Piedmont, grows in sandy or rocky, open, upland woods on acidic or circumneutral, well-drained sands or sandy loam soils with low cation exchange capacities. The species is also found on sandy or submesic loamy swales and depressions in the fall line Sandhills region as well as in openings along the rim of Carolina bays; maintained railroad, roadside, power line, and utility rights-of-way; areas where forest canopies have been opened up by blow- downs and/or storm damage; small wildlife food plots; abandoned building sites; under sparse to moderately dense pine or pine/hardwood canopies; and in and along edges of other artificially maintained clearings undergoing natural succession. Based on the surveys conducted across the subject property, habitat potential would be considered low across the site. These surveys did not reveal any occurrences of Michaux’s sumac. Additionally, the NCNHP records indicate no documented occurrences of this species within 1.0 mile of the project site. Therefore, the proposed project is not anticipated to affect this species. Biological Conclusion: No Effect Schweinitz’ sunflower (E) tends to grow in soils that are thin, and generally occur on upland interstream flats or gentle slopes, on soils that are clayey in texture, and, when weathered from metasedimentary rocks, often contain large quantities of slaty rock fragments. This species also inhabits generally open areas, with abundant sunlight and little competition from other vegetation. The majority of the project site is forested and has been for many years. However, there are a couple of small early successional fields that occur on site. These early successional areas, along with the roadsides and power rights of way offer marginal habitat. These areas were surveyed in late September-early October 2022. The systematic survey of these areas revealed no individuals of Schweinitz’ sunflower present on site. NCNHT records review indicates that there are no populations that occur within a one-mile radius of the subject property. However, there is potential marginal habitat present on site.With this in mind, we would propose a biological conclusion of May Affect, Not Likely to Adversely Affect. Biological Conclusion: May Affect, Not Likely to Adversely Affect Summary Habitat potential Carolina heelsplitter is presenton site in the two small streams. Habitat for Schweinitz’s sunflower would be considered marginal due to the presence of early successional fields and road/power easements. These marginal areas were surveyed and no individuals were found during those surveys. For these two species we have proposed a May Affect, Not Likely to Adversely Affect biological conclusion. Habitat for Michaux’s sumac was considered low, and no individuals were found during surveys.
