North Carolina 28224 Subject: Issuance of NPDES Permit NC0033421 College Park Subdivision WWTP Gaston County Dear Mr. Daniel: In accordance with your application dated February 15, 1996. we are forwarding herewith the subject State-NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency dated December 6, 1983. In a letter dated July 22, 1996, Mr. Bruce Haas of your office requested two changes to the draft permit. The Special Condition Part III, Item D is standard language for all permits, and cannot be changed on a permit by permit basis. Thus, the language will remain the same. Mr. Haas also requested modification to Item E of the Special Conditions. The change recommended does not alter the intent and requirements of this condition in a significant way. It is the Division's intent to permit the most environmentally sound alternative of the reasonably cost effective options. Because of the close proximity of the subject facility to the town of Dallas' sewer collection lines, the alternatives analysis is still required as stated in the permit. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611- 7447. Unless such demand is made, this decision shall be final and binding. Please take notice that this permit is not transferable. Part II, E.4. addresses the requirements to be followed in case of change in ownership or control of this discharge. This permit does not affect the legal requirement to obtain other permits which may be required by the Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local governmental permit that may be required. PART _V - EVALUATION AND RECOMMENDATIONS Carolina Water Service, Inc. , of N.C. is applying for renewal of the permit to discharge treated domestic wastewater into Little Long Creek. A review of the past year' s self-monitoring data, from 03/95 through 02/96, showed seven (7) daily maximum violations for Fecal Coliform. Carolina Water Services, Inc. , was requested to remove the aeration system from the chlorine chamber. A condition in the permit relative to this is suggested.
