Hi Tim,
I was able to confirm with a few other folks that this will need a 401 and buffer authorization, since it cannot be covered
under the GC4244 due to the need for a buffer authorization. Please follow the process for submittal in my previous
email below:
It appears that this will fall under the buffer rules as 15A NCAC 02B 0.0714 11 nn ii as "allowable upon
authorization". Since your construction corridor of 75LF has kicked this into requiring a buffer authorization, it
will no longer be covered under our general certification (most likely GC4244 — oil and gas utility lines).
You will need to submit a PCN and reach out to the USACE to make sure you do not need anything from them as

processed into our queue for review.
We can consider the previous conversations as part of the notification for the application. To meet the full requirement,
please also send an email to 4¢ 1P1.2 %I (ncd nr: v_ and cc me for confirmation. Once the application and fee are
received, it will be processed through central office and then show up in my queue. Please make sure that the
application is complete and all temporary and permanent impacts to streams and buffers are indicated on the PCN and
match the impact maps so that I can quickly review and issue the permits without having to ask for additional
information.

Hey Zach,
Thanks for taking our call this morning. We did not submit a pre -filing meeting request because we were under the
impression we would only be submitting the Buffer Authorization Form. I can submit one today but will likely submit the
PCN before the 30 day period and we do not want our application to be returned as incomplete. Can we consider this e-
mail as the pre -filing request? Please advise.
Also, the NCDOT ROW within the Riparian Buffer is approximately 45 feet, if this area is considered an exemption then
the widest area within the buffer would be 30 feet. See the attached exhibit showing the projects LOD and existing
ROW.

The angle of that crossing is right at 75 degrees, but the construction area width in this area in about 75 ft. Does that put
us into (oo)? The impacts to the stream are approximately 83 LF or 0.05 acres. Where does that put us for required
permitting?

What is the angle of the gas line when it crosses the stream/buffer? It is hard to tell on the map what the angle of entry
is with the partial section of stream that 'juts' pasts the box culvert wing.

For it to fall under (nn)(i) as deemed allowable it would need to be perpendicular (75-105 degrees) and have a
construction corridor of lass than or equal to 50 LF (with maintenance corridor of 30 LF or less).
If it is considered not perpendicular, then it would fall under (oo)(ii) or (oo)(iii) depending on the total impact areas.

Thank you for taking the time to chat with me. Regarding that Riparian Buffer Authorization, could you please confirm
for us whether or not that would be required based on the Exhibit I have attached. I think we should fall under (nn) of
that Table of Uses in the Neuse River Basin Buffer Rule PDF as we are very close to perpendicular when we cross the
stream.
