February 2, 2006 CERTIFIED MAIL RETURN RECEIPT REQUESTED Tim Johnson, PE, Division Engineer Division 8 NC Department of Transportatiori PO Box 1067 - Aberdeen, NC 28315 Re: Water Quality Certification for Proposed Improvements to SR 2316 in Chatham County, DWQ No. 20030596 Dear Mr. Johnson: The Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification for the aforementioned project: Review of your application revealed it lacking necessary information required for making an informed pernut decision. The pernut application was deficient in the following areas: The drawings provided in your application do not show the existing pipe locations at the road cro.ssings of the LTT to Indian Creek and the UT to Bear Creek. Please provide drawings that show the existing pipe locations, orientations, and dimensions. Based on a field visit of the project, the drawings provided do not match the existing stream patterns. Specifically, the stream patterns at Sites 1 and 2 make a sharp.angle turns in the immediate vicinity of the existing pipes. These tight turns could cause stream instability once the new pipes are installed. Please provide drawings that accurately represent the existing conditions and show any armoririg or stream pattern changes•needed to establish stable stream banks. Any additional impacts to the streams as a result of armoring or stream pattern changes should be listed in Stream Impacts table in the PCN. It is unclear why there is no stream diversion drawing for the Sites 1 and 3 pipe replacexnents. All pipe replacements shall be done in a dry work area. Please provide diversion plans for Sites 1 and 3 or provide explanations for how a dry work area will be maintained during the pipe replacements. If diversions are to be used, the temporary impacts for the diversions should be listed in the Stream Impacts table in the PCN. The Stream Impacts table in the PCN lists impacts at Sites 1, 2, and 3 of 40 lf, 281f, and 361f, respectively. The sum of these impacts is 1041f. However, the Cumulative impacts nanative says the total impacts would be 981f with an additional 30 lf of impacts for rip-rap at Site 2. The Stream Impacts table should be revised to include the rip-rap impacts at Site 2 for an overall total of 1341f of impacts. Please provide a revised PCN with the correct stream impacts. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the pernut application on hold until we are supplied the necessary information. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
