Mr. Thomas stated that the environmental permitting is a process, and that the courts judge the Corps on how we get to the final decision. He also discussed to 2011 permit. He stated that the 2011 permit was applied for and permitted as a linear transportation project. At the time of permit application, the road stubbed out to nowhere. The applicant ( Novant) had to give a project terminus as part of the PCN, and it was reported that the road would tie into Peacehaven. The Village said that it was always their plan to connect in the location as proposed today. Their planning documents reflecting back to the late 90's show the road in the same location. As a linear transportation project, each crossing could be looked as a single and complete project, and each crossing could impact up to 300' of stream without crossing the Individual permit threshold. Mr. Thomas said based on the new Purpose and Need that the project will be viewed as a development access road, not a linear transportation project. As a development access road, the threshold will be 300' total stream impact and /or 0.25 acres of wetland. The existing impacts to for the crossing that was installed under the Novant permit will be cumulative with the new impacts. So, the current project will be meet Individual Permit thresholds. A 120 day permit review time will be required, including a public notice. Mitigation will be required at a 2:1 ratio since we're over the IP threshold. We need find out if the crossing that was permitted with the previous project was paid for. Amy Euliss will do look into this. Ms. Euliss stated that NCDOT would transfer maintenance over to the Village of Clemmons one year post construction. She asked if the Village of Clemmons and /or NCDOT would need to be the permittee. It was suggested that NCDOT and the Village be co- applicants with specific language added to the permits regarding who would be responsible for which parts. NCDOT would also request that the permit in its entirety be transferred over to the Village with maintenance of the road. Ms. Homewood asked Mr. Thomas to discuss the need for an alternatives analysis. Mr. Thomas said that because the project is for development of the specified area, that the permit application would need to discuss avoidance and minimization of the road itself (i.e. slope stakes, minimum width to carry traffic volume, etc.). Ms. Homewood said we would need to state why the road couldn't go around the wetland area and the stormwater pond. Mr. Howard said that there would be issues with road geometry and tying in with existing developments. Ms. Euliss said we will need that information to include in the permit application. Ms. Euliss asked if we would need to prepare a JD for the entire development or just the road. After considerable discussion, it was determined that a JD would only need to be prepared for the road. However, the permit application needs to lay a conceptual plan with access points from the proposed road to determine if future impacts are possible to access the developable tracts. Those impacts won't need to be included in the permit; however, any future impacts to developments from the road will be considered part of the larger project. Those developers will be responsible for their own permits; however they will automatically be required to pay mitigation for any impacts and apply for an individual permit. Ms. Euliss asked Ms. Homewood for clarification regarding NCODT's Individual Stormwater Permit. Since the road will be maintained by the Village of Clemmons, the post- construction stormwater will need to be approved by the NCDEMLR stormwater group. The Village should still be able to used NCDOTs BMP manual for stormwater device design. Currently the road has biocells designed. It might be in the Village's best interest to look into utilizing NCDOTs BMP manual. Ms. Euliss asked if NCDOT could use their Individual Permit for Construction Stormwater purposes. Ms. Homewood didn't have concerns with NCDOT using their permit for construction stormwater. Ms. Homewood asked if there was a grant expiration date. It was determined that NCODT is now funded to construct the road, and that there is no known date. Ms. Euliss said that Rachelle Beauregard with PDEA would be contacting the agencies regarding a jurisdictional determination. NCDOT and the Village of Clemmons will be working out a municipal agreement shortly.
