All is well here. I hope the same for you.
With regard to the purpose of the fill, after reviewing the town's ordinances and seeing the site in person,
it became evident to me the purpose of the fill is to provide adequate area for EMS, public safety and
maintenance vehicles with trailers, to turn around. As you are aware, the entrance into the property,
is very narrow (i.e., 12'), and due to the property being a third tier lot a proper turn around area
must be in place for EMS and public safety vehicles. It was brought to my attention the police and
maintenance vehicles routinely use this area to turn around. In fact, on the day I was there, a yard
maintenance truck, with a trailer, was using the area to turn around, and there were no cars at the
property. During the warmer months, when multiple private vehicles, boats and other water craft
are parked or stored on the subject property and on adjoining properties, the turn around area, is
very limited. The expansion of this area and subsequent fill of wetlands ensures these vehicles can
easily enter and depart the area without concern of private vehicles impeding maneuverability.
The previously submitted credit reservation letter reflects a 3:1 mitigation to impact ratio (0.105 acre). I
requested it that way, in the event that the Corps did not accept the 2.95:1 proposal.

Hi Dana,
I hope you are doing well. I have been meaning to reach out to you regarding this project. Attached
is PCN form for your reference, with the highlighted areas (2) that need attention: 1) Purpose of the
project, and 2) proposed mitigation. First, the identified purpose of the proposed remaining fill is 'to
provide an adequate maintenance corridor for the existing dwelling'. There is already a maintenance
corridor around the house, and the fill area proposed to remain is located next to the existing
driveway, not the house. Please clarify the reason to leave the fill in place.
Second, the Corps has determined that a 3:1 ratio for the currently unauthorized fill to remain in
place is appropriate given the location of the wetland fill (adjacent to coastal marsh on a barrier
island) and nature of the activity (unauthorized placement). Cost of credits is not considered when
determining the ratio to offset the loss of wetlands. If the applicant wishes to keep mitigation costs
at 0.10-acre, then the proposed remaining fill should be reduced to the necessary square footage to
equate to a 3:1 ratio of 0.10-acre credit required, or an updated credit reservation letter is needed
from the bank for the proposed 0.035 acre fill to remain.
Please provide the requested information no later than 15 days of the date of this email
(3/25/2023), or at your earliest convenience.
