Scarborough Bank Parcel Credit Release — Task 5
Dear Mr. Cousins:
On November 4, 2022, the Division of Water Resources (DWR) received a Year 2 Monitoring
Report from Water & Land Solutions, LLC (WLS) for the Scarborough site. Overall, site
conditions appear to look good with the vegetation exceeding performance criterion and no
encroachment within the conservation easement areas was observed. Lastly, according to information
provided in the report, "all coastal headwater reaches are meeting the requirements for coastal
headwater channel formation ".
DWR received a continuation certificate and rider for performance bond (#SUR2003575) issued to
WLS from Frankenmuth Mutual Insurance Company, in the amount of $60,000, to cover monitoring
and maintenance at the subject site. The term of this bond ends with the approval of the Year 3
Monitoring Report by the DWR. Future credit releases will be dependent on both the renewal of this
performance bond and the annual monitoring reports.
In accordance with the MBI, signed on November 18, 2019, the following Project Milestones have
been met and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements for
the above -referenced tract and 10% of your Nitrogen nutrient offset credits
(0.10 x 35,390.92 lb-N = 3,539.09 lb-N) are now available for sale and 10% of your Neuse riparian
buffer restoration credits (0.10 x 694,782 ft2 = 69,478.20 ft2)

Please note that nutrient offset credits generated at this site must be used for impacts in HUC
03020202 of the Neuse River Basin pursuant to 15A NCAC 02B .0703, which became effective
on April 1, 2020. Additionally, the riparian buffer credits must be used for impacts in the
Neuse River Basin in accordance with guidelines in the Consolidated Buffer Mitigation Rule,
15A NCAC 02B .0295, which became effective on November 1, 2015.
