permit. Accordingly, we are forwarding the attached final NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum
of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15,
2007 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or
Local governmental permits which may be required.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
- permit conditions, requirements, terms, and provisions included -herein.
Aqua North Carolina, Inc. is hereby authorized to:
1. Continue to operate an existing 0.260 MGD wastewater treatment system with the following
components:

♦ Bar screen
♦ Flow splitting device
♦ Four extended aeration package treatment plants

The facility is located at 900 The Cape Boulevard, Wilmington in New Hanover County.
2. After receiving an Authorization to Construct from the Division, expand the wastewater treatment
plant capacity to 0.40 MGD, and
3. After receiving an Authorization to Construct from the Division, expand the wastewater treatment
plant capacity to up to 0.75 MGD, and
4. Discharge from said treatment works at the location specified on the attached map into the Cape Fear
River, currently classified SC (PNA) waters in sub -basin 03-06-17 of the Cape Fear River Basin.

A.(4.) ENGINEERING ALTERNATIVES ANALYSIS REQUIREMENT
Prior to expansion stages, the permittee shall submit a detailed analysis of all available means to dispose of this
facility's wastewater. This Engineering Alternatives Analysis (EAA) shall be prepared in compliance with the
Division's guidance document for EAAs.
If no EAA is submitted, the Division may reopen and modify this permit to increase monitoring frequencies or
change the effluent limits as necessary to protect the receiving stream.
A.(5.)'PERMIT RE -OPENER: SUPPLEMENTARY NUTRIENT MONITORING/TMDL IMPLEMENTATION
Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in the North Carolina
Administrative Code at 15A NCAC 2H.0112 (b) (1) and 2H.0114 (a) and Part 11 sections B-12 and B-13 of this
permit, the Director of DWQ may reopen this permit to require supplemental nutrient monitoring of the discharge.
The purpose of the additional monitoring will be to support water quality modeling efforts within the Cape Fear
River Basin and shall be consistent with a monitoring plan developed jointly by the Division and affected
stakeholders. In addition, the results of water quality modeling may require that limits for total nitrogen and total
phosphorus be imposed in this permit upon renewal.
The Division may, upon written notification to the Permittee, re -open this Permit in order to incorporate or modify
effluent limitations, monitoring and reporting requirements, and other permit conditions when it deems such action
is necessary to implement TMDL(s) approved by the USEPA.
A. (6.) SPECIAL CONDITION — EXPANSION PLANS
No later than 180 days after the effective date of this permit, the Permittee shall submit an update to their plans
for expansion above 0.260 MGD. Expanded limits were added to the permit to accommodate flows from Dolphin
Bay WWTP (NC0055107) as well as those currently allocated to the Ocean Forest service area (EAA, June 2006).

The following modifications have been made to the draft permit:

• Fecal Coliform monitoring/limit has been removed from Section A.(1.).

143-215.1(a1) states : In the event that both effluent standards or limitations and classifications and water quality
standards are applicable to any point source or sources and to the waters to which they discharge, the more stringent
among the standards established by the Commission shall be applicable and controlling.
The water quality standard of 10 mg/L is more stringent and controlling. I'm going to get on my soap box here for a
moment. We have grossly missed the proper classification of a huge segment of the Cape Fear River for PNA/HQW long
ago. I assure you the PNA status was established before these two facilities were built. So, we can also argue that when
we have found a mistake in our permit limitations (I'll find that reg in the general statute if you give me time... ) we are
obligated to correct the issue in the permit. All we are asking in the region is for DWQ to honor the general statute 143-
215.1(a1) and impose the 10 mg/L limit if the facility has tertiary treatment. We agree, at this point, we can't impose
the tighter standards on the rest who don't have tertiary treatment, but will provide appropriate limitations upon
expansion or upgrade. I'm not sure how we would explain to our good friends with CHPP that we aren't going to make
our ww facilities use their tertiary filters (when they have them) to meet a PNA standard.
Please, I've been battling this PNA issue for over two years... I had to explain to the CHPP steering committee, how we
managed to miss this.. let's get the stakeholders involved and make sure we make a good and defendable decision on
this. Please....

Dean if you look at the rules for HQW (15A NCAC .02B .0244) you are correct that new discharges get a TSS limit of 10
mg/L. We have assumed that meant that was for a monthly average, and have been giving a 1.5 times value for daily
maximum.
However, you review the rule for expanded discharges, it reads, "All expanded NPDES wastewater discharges in High
Quality Waters shall be required to provide the treatment described in Sub -Item (1)(b), except for those discharges
which expand with no increase in permitted pollutant loading".
So, what I took this to mean was that expanded discharges did have to meet the same 10 mg/L for TSS spelled out in 15A
NCAC .02B .0224 (1)(b) that new discharges had to meet unless they could discharge at the higher volume without
adding to the total TSS load. Being the new guy, and thus not sure of my interpretation, we brought the issue up at
Monday's staff meeting. The discussion that occurred at the meeting confirmed my interpretation. So, what that
means, is that limits for an expanded discharge are based on a mass balance calculation. In this case, a doubling of the
discharge from 100,000 to 200,000 reduces the concentration from 30 mg/L to 15 mg/L. The increase to 500,000
reduces to 6 mg/L so the limit then becomes the prescribed 10 mg/L. The presence of absence of tertiary filters doesn't
come into play in the limit calculation, as much as we might like it to.
I hope this helps explain why we used the limits that we did in the various permits that have been swirling around lately.
We will be working with Planning to get the PNA/HQW issue in BIMS rectified.

OK, a little follow-up.
NCO057703:
I/we use the system description in permits to determine what should be present and has to be maintained in
operation or a condition for potential use at the facility, thus we view it as very important that it is accurate &
correct and as complete as possible. This particular facility replaced its tablet chlorination system from each
package plant/train with a new & improved single dosing location/system and replaced their effluent pump tank
with a 25% larger unit; in both cases no A-to-C was obtained and it was not like -for -like in my opinion. However
given the lack of a good system description in existing permit and fact that what they did should not cause an
issue and be better, we did not pursue enforcement.
The current facility & its flow of 0.260 MGD does not have tertiary filters, thus old TSS should remain. However,
both the 0.400 & 0.750 MGD sets of limits are expansions and should have new TSS limits of 10 & 15 as A-to-C
for expansion will be required and filters can be added at that time to meet these limits and assist in meeting
the tighter BOD and new Ammonia limits.
• Gotcha on the increased frequency questions and I don't see any reason to increase them at this point.
• Missed the cover letter item as probably looked at the other permit's letter, thus we are good there.

See responses below. I've included an updated pdf for NCO065480 reflecting a correction to the facility location and the
additional treatment components you mentioned.
For NCO057703:
• In the Description the two 30K and two 100K treatment trains are the extended aeration package plants in Item
6 and I would state that Dechlorination is Liquid.
Their renewal application states they have a new tablet chlorinator. I understood that they want to be allowed
to switch to liquid but they have not stated that they have, nor have they indicated they have the equipment in
place to do so. I mentioned in an email in August that we don't provide that kind of authorization. We want
them to chlorinate, we don't get into telling them how to do so. As long as they have the necessary permit
and/or ATC.... then they can do what they wish as long as they comply with the permit.
• Why is the stricter TSS limit not being applied to the 400K flow level as new infrastructure will need to be
designed, approved, & built to take any flow over 2600
They did get new TSS limit based on 15A NCAC 02B .0224(1)(c).
• Do the monitoring frequencies not increase as flow increases?
• Not necessarily — monitoring frequency is typically based on the class of the facility. See 15A NCAC 2B .0500.
• The cover letter needs to direct them to CG&L for an A-to-C to change their chlorination system/method — their
renewal request mentioned wanting permission in this renewed permit.
I did direct them to CG&L in the cover letter. The second paragraph reads: "A request was made in your permit
renewal application to switch to liquid chlorination, please be sure to apply for the appropriate Authorization to
Construct (see http://portal.ncdenr.org/web/wq/cgls/permit/atc)."

2. Permit needs to have the Daily Limit of 276 for Enterococci applied to permit. This outfall is ✓
adjacent to a public park with _fishing pier & small boat launch and a private residence. Given
history of facility and somewhat poor flushing, bacti sampling should be increased to at least ?

WWTP.

RESIDUALS PLAN
AQUA, NC, COASTAL REGION
Sludge hauling from the plant is handled through an agreement with McGill Environmental. During
normal operation, waste solids are wasted to the solids holding tank to be thickened by settling &
decanting. Thickened sludge is tested to determine when it reaches approximately 2% solids content
before hauling. McGill brings a mobile dewatering unit onsite & dewaters the sludge, adding polymer &
returning the released water back to the head of the plant. The sludge is stabilized by McGill's
composting process to meet the requirements of Class A Biosolids, at McGill's permitted facilities,
WQ0006816 & SWC1906. TCLP analyses are kept on file at McGill & Aqua offices.

PLAN OF ACTION FOR THE CAPE WWTP
Aqua's long range plan for maintenance & upkeep to the Cape WWTP includes a number of major
Capital improvements planned over the next 5 years. These planned Capital improvements are a part of
Aqua's 5 year Capital Budget Plan just recently revised & approved. Included in that plan for The Cape
are monies for painting of the plant in 2012, upgrades to the security fencing in 2013, & a new digester
to replace the old one in 2013. Aqua's 5 year Capital Budget is reviewed & revised yearly to reflect
current needs. While these are specific planned larger capital outlays, Aqua will continue to evaluate &
make necessary repairs to the air & diffuser system on an as needed basis. Aqua has just recently
implemented an Asset Management Program, Maintenance Connection, which will help identify & track
needed maintenance on all of our facilities. Maintenance Connection will be linked in with our work
order program & budgeting process to allow for a more thorough review & tracking of our facility
maintenance needs.

Comment: The mixed liquor appearance in the 4 aeration basins could not be more
different ranging from being on the dark & heavy side to thin & watery in appearance. It
is most likely a result of uneven flow distribution from the splitter box and perhaps
uneven wasting practices. MLSS values were measured using a portable TSS meter
with the following results: #1 = 1600-2100; #2 = 1800-2300; #3 = 2700-3200; #4 =
3600-4100 mg/L. The Utility should examine this issue to determine how best to
address it as it could lead to future compliance problems and is affecting clarifier
settling. This plant could benefit from Flow Equalization with a better flow distribution
system to the basins.

Comment: Digester has some small leaks where walls have rusted through. Tank sits
on bare ground in a slight excavation or depression -- it is prone to float when empty or
nearly so and a sump pump in a collection box is present to collect & lower groundwater
near surface.

Comment: Unusual system with each treatment train's effluent passing through its
own tablet box before dumping into contact chamber -- this system is relatively new as
far as equipment age. Some denitrifying sludge was present and the amount should be
closely monitored to prevent a media for re -growth. Should be measuring "free"
chlorine periodically and when bacterial samples are taken so that some correlation can
be made between value and that of bacti counts. "Free" chlorine should be in the 1-2
mg/L range before any dechlorinaton occurs.
