Hi John —
I've spoken with Nick Coco, an engineer in our NPDES Complex Permitting Unit (in copy). As I understand it, we would
not have any issues with the project as you've described. We would approach in the same manner as we've done in the
past with the Beau Rivage WWTP. We would review the wetland setback encroachment and siting to ensure no negative
impacts on the water resources. Provided no issues, NPDES would be agreeable to allow the siting within the 50' setback
outline in 15A NCAC 02T, but no further than the existing footprint. Please ensure the wetland delineations are
accurate/up to date.

Hi Paul,
Just checking on the requested encroachment into the wetlands setback. Since it was allowed for the Beau Rivage
WWTP, and The Cape WWTP has an identical situation, I was hoping that the Beau Rivage decision would have set the
precedent for this request. I would like to offer whatever assistance I can to move toward a decision on this; if it would
be helpful for me to meet with you and others, please let me know and I will be glad to do so.

Thanks for the email. I'll look into it and get back in touch as soon as possible. I believe I'll need to pull someone in from
our PERCS unit who implement the 02T rules. I've reached out to them and will be back in touch once we've discussed.
